1871 Great Register of Humboldt Co., CA, printed copy on LDS Film#976464, states that Oliver Stevens McCoy, 22, born MO, laborer in Ferndale, registered to vote. He was on the supplemental list of persons registered from Aug. 4 to Aug. 30, 1871. He did not appear on the list 1 Oct 1872, but did appear on 1 Aug 1873 and on 6 Aug 1875 lists. He did not appear on the 20 Aug 1879 list.

According to an article in the Advance Register on Monday, 22 Sep 1986, page 6, on Tulare Lake, a boat called The Water Witch was sold by a man named Smith to "brothers named McCoy" in exchange for some cattle. The McCoys used the boat for two years to fish for terrapin,which could be sold for $4 a dozen in San Francisco. She capsized in 1880 or 1882, depending on the source, and was apparently no longer owned by the McCoys at that time.

An article in Los Tulares No. 110 on June, 1976 says that the Mose Andross (another boat on Tulare Lake) was abandoned near Lemoore in 1879 and part of her was converted into a ferry boat by two men, John Chism and Oliver McCoy, but apparently was not long in service.

Tulare Co., CA, Superior Court Case #30, complaint filed 06 Oct 1879. Maurice Dore, plaintiff vs. O.S. McCoy, defendant. Complaint states that plaintiff, since 22 Aug 1876, owned property at NW 1/4 of S1 T20SR19E and SW 1/4 of S36 T19S R19E, MDB&M, containing 320 acres. On or about 1 Jun 1878 defendant "wrongfully and unlawfully ejected and ousted" plaintiff. Value of the use, rents, issues and profits of the land from 1 Jun 1878 was $1,000. Service made 8 Oct 1879. Case went to court 30 Jan 1880 without a jury. Defendant did not appear in person or by counsel. Judgment issued in favor of plaintiff giving him possession of the property and for $160 for rents together with costs of $22.50. Judgment recorded in Judgment Book 1 of Superior Court, page 16. Note: case #31 was a similar suit by Dore against Isaac McCoy and Robins McCoy for different property. Copies in possession of author.

Bk X pg 200, Tulare County Recorder. Deed dated 24 Jan 1880. O.S.McCoy of Tulare County deeded to H.A. McConnell of Merced Co., for $250, the S half of S13 and the S half of S 14 in T24S R21E, MDB&M and located in Swamp Land Survey No. 24 in Tulare County. (Note that Oliver's sister Harriet was H.A. McConnell). Recorded 24 Jan 1880 at the request of O.S. McCoy. Copy in possession of author.

July, 1884, a complaint was filed against Oliver in Mussel Slough Township, Tulare County, charging him with robbery of $100 from a chinese man. The testimony of that man is included in the documents on film, but not Oliver's testimony and not the jury's findings. The instructions to the jury suggest that the judge thought Oliver guilty, but they did include definitions of robbery, larceny and grand larceny. His instructions on how to evaluate Oliver's testimony were interesting. Copy of all that is on film is in the possession of the author.

When Oliver filed bankruptcy in Feb, 1886, he owned 3 horses, 8 hogs, 5 dozen chickens, 1 small dwelling house, household and kitchen furniture and bedding, 2-horse farm wagon and 1 light spring wagon,with total value of $450. All but 1 horse and 4 hogs were exempt. He did not own any real property. Debts totalled $2,007.25. Discharged 20 Sep 1886.

Bk 24 pg 51, Tulare County Recorder. Deed dated 21 Sep 1887. O.S. McCoy and E.R. DuBrutz deeded to S.D. Ayers for $3,850.00. the North half of S6 T21S R22E, MDB&M, subject to mortgage lien made by E.R. Dubrutz on 18 Nov 1886 to Sallie R. DuBrutz and recorded 19 Nov 1886 at Book Z pg 606 of Mortgages. Superior Court Case #1609, B. Fisher vs O.S. McCoy. Complaint stated that during 2 years previous to the action, McCoy became indebted to L. Schoenfeld & Co., a mercantile firm in Tulare, for $894.47. McCoy did pay $151.00. Schoenfield turned account over to plaintiff for collection. Deputy sheriff filed statement that on 10 Oct 1887 he attached 250 head of hogs more or less running on the range at McFaddens ranch on Tulare Lake 20 miles SW of Tulare City and attached the same by taking into his custody and putting a keeper in charge.

Tulare Co., CA, Superior Court Case No. 1609, complaint filed 06 Oct1887. B. Fisher, plaintiff vs. O.S. McCoy, defendant. Complaint states that during the two years past the defendant became indebted to L.Schoenfeld & Co., a mercantile firm in Tulare, for $894.47 for goods and for money loaned to defendant at his request. That defendant paid $151.00 on this debt. Schoenfeld & Co. assigned the debt to the plaintiff. Served on 10 Oct 1887. Writ of attachment issued 06 Oct 1887 and on 10 Oct the Deputy Sheriff attached 250 head of hogs more or less running on the range at McFaddens ranch on Tulare Lake 20 miles southwest of Tulare City by taking them into his custody and putting a keeper in charge. Defendant did not answer the complaint and a default judgment was entered on 24 Oct 1887 for $743.47 damages and $50.45 costs of suit in Judgment Book No. 2 page 195. Copies in possession of author.

Articles in the Daily Californian, Bakersfield, Kern County, CA, on July 6, and 7, 1891 and in the Weekly Californian July 11, 1891, along with the book South Fork Country by Bob Powers, give details of Oliver's death. He was in the mountains near Coyote Holes, Kern County foothills, coyote trapping with some other men. Sheriff Johnny Powers and Sam Gann, constable from Kernville, came on their camp Friday, July 3, 1891, on their way to an Indian camp to arrest an Indian by the name of Wampei Jiggens who had set fire to a hay stack.They asked if the trappers would like to join them and Oliver said if they would wait until he finished breakfast, he would. The men were attacked by the Indians and Oliver and the sheriff were killed. One article said that Oliver was shot in several places, two of which would cause death, but he was not mutilated but another indicated that his "face bore evidence that the fiends had jumped and trampled upon it, tearing and breaking the flesh from the bones." The bodies were removed to South Fork, where the sheriff lived. An inquest was held on July 4. Sheriff Powers was buried in the Cottage Grove Cemetery at Onyx, CA, a family cemetery. Bob Powers, a descendent who has written several books on the area wrote me that he believed that Oliver was buried there also, but there is no marker. According to the papers,Oliver was about 40, a liveryman in Lemoore and left a wife and six children. Photocopies of newspaper articles are in my files. Articles were in the Visalia Times Delta as well as the Weekly Californian and the Daily Californian.

Kern County, CA, has a Law Enforcement Memorial on line at http:www.co.kern.ca.us/sheriff/kleomem.htm that is a roll-call of all law enforcement officers who died in the line of duty in Kern County. It includes "Kernville Constable John L. Powers and Citizen Volunteer Oliver McCoy died July 3, 1891 after being shot attempting to serve a warrant of arrest."


William and Lillie Worthley, their children Lee and La Wayne are buried in the Visalia cemetery in the Worthley plot and Doris is in the adjoining plot on the west of theirs.
Veda McCoy knew Dan McCoy. He was the brother of Oliver Stevens McCoy. He never married and was not implicated in the trouble.
