NOTE: Not to be confused with John Petty of Stephen F. Austin's Old Settlers who came to TX in 1823 and granted a sitio of land in Fayette Co on 8/10/1824. Listed in 1826 TX census living in Bastrop Co with an age between 40 and 50.

John Petty was born 12/9/1801 in TN. He is rumored to be one of twelve sons. Under the Occupant Law of 1826, the following Petty filed for homestead claims in McNairy County, TN. Among them was John Petty, filing for 132 1/2 acres on 3/5/1827 (Land Grants of McNairy Co., TN, 1823-1851, Vol A-C). Also filing on this same date was James L Petty for 100 acres and Wilson Petty for an undetermined number of acres. In 1824 William L Petty claimed 20 acres on Warrant #6193. All of these land claims were in the 9th district, first through fourth ranges and first through fifth sections. These men may be the brothers or cousins of John Petty of Pettytown.

9/24/1831, John Petty sold 61 1/4 acres to John Smith for $300. This land was a part of the 122 1/2 acre tract located in McNairy Co on the Little Hatchey. 10/10/1831, John sold 160 acres to Robert Rankin for the sum of $1500. The Pettys were living on this land at the time which was located in McNairy Co in the 9th District, 3rd range, Section 3. This was about the time the Pettys moved to Carroll Co, ARk, selling their farmlands beforehand. John Petty moved from Tennessee to the Ozark region of Arkansas and Missouri about the year of 1835. During the family's time in the Ozark region, the Pettys met and became friends with the Queens, Fowlers, Baizes and Williams'. These families together traveled to Texas and also settled together or in nearby counties.

Some say that John fought in the Texas Revolution. If so, that year would have been the logical time to have left his family in Arkansas and his coming on to Texas. The exact date that John Petty brought his family to Bastrop County, Texas, is not known but it is believed to have been before 1850. (See census above as he was in AR in 1850). The 1860 Census taken from Bastrop County gave the real estate of John Petty as being worth about $1,500, which was quite a bit for that early year. We do know that he settled several of this children, including two or three widows, around him. Such land could have been a grant from the State if he did fight for Texas' independence. In 1871, John Petty pre-empted 160 acres of the public domain in Bastrop-Caldwell counties and received title to this land on 9/7/1876. The property ran along Walnut Creek, a tributary of the Colorado River, to a point thirteen and one half miles east of Lockhart. On 12/10/1877, John Petty sold this land to his son, John M Petty, for $600. Bastrop CO land records, BK.Z, page 625. On this date he also bought 198 acres, plus two forty acre tracts along Walnut Creek and Elm Creek for $900 from the same son. (Bastrop CO land records BK Y page 124). It is said that the Bastrop/Caldwell County lines ran through the middle of his house.

John Petty made his living in the early years by freighting lumber, etc., from South Texas. This he did by oxcart. Many of the old homes in Pettytown were built of lumber that he had brought into the country that way.

Today the area that John Petty and his family live is called Pettytown even though may of the Petty's moved away. The Pettytown Cemetery contain many graves of this and associated families. The Cemetery association has been in existance for 50 years and has established a fund to maintain the area. It gathers once a year in May on the cemetery grounds located on Co Rd. 267 near the Red Rock, Bastrop Co, TX area.
