NOTE: In the Deed Index copied at the courthouse, I have A.J. deeding to James Pearson on 26 May 1852. I had previously entered the information that he was buying. Not sure what is correct.

At the March term, 1911, David McDowell filed a petition in District Court of Poweshiek Co., IA, for appointment of guardian for his father. Petition said:
"Now comes David McDowell and petitioning the Court for the appointment of a guardian of the person and estate of the defendant A.J. McDowell, states:-
That the defendant is now an old man. that he will be eighty one years of age on the 26th day of March, 1911, that he is weak both in body and mind; being of unsound mind to such an extent that he is incapable of managing his business affairs or caring for himself personaly.
That he has converted all his property into cash, amounting to about Eighty Five hundred dollars; that he refuses to loan or invest his money, or to deposite [sic] the same in a bank, but keeps the same on his person and about his dwelling house.
That it will be for the best interest of defendant that he have some suitable person appointed guardian of both his person and estate.
That the plaintiff is a son of the defendant and personally interested in his wellfare.
Wherefore, he asks that he, plaintiff, or some other suitable person may be appointed temporary guardian of said defendant, that that a time be fixed for hearing as to the appointment of a permanent guardian of said defendant, and that on the hearing that a permanent guardian may be appointed of the person and estate of said defendant,and for such other and further orders as may the Court seem just in the premises." Signed J. W. Carr, Attorney for Plaintiff, then by David McDowell, on 18 March 1911.

H. F. Morton was apparently appointed temporary guardian and filed a $17,000 bond on 5 April 1911. A Petition for Order was also filed March term 1911, stating:
"Now comes H. F. Morton temporary guardian of A. J. McDowell a person of unsound mind, and peritioning [sic] the court states: That he was appointed temporary guardian of said A. J. McDowell on the first day of this term of court; that he duly qualified as such by executing a bond in the penal sum of $17000. and other wise qualified as required by law. That he has received as such guardian the sum of $8400. being all the property of his ward except some household goods of but little value which is now used by his ward. That his ward is about eighty years of age and is in poor health. He further says that his ward has a wife who is old and weak in both body and mind and unable to care for herself. That it is necessary to have some one to look after both his ward and his wife, and in his judgment it will require the sum of $75 per month to furnish them the necessary care and comfort the extreme age and helpless condition requires. He further says that his ward and his wife slipped away from home and went to visit some friends in Ohio, and the friends wired David McDowell a son of his ward to come after them, and he went and brought them home at an expense of $32.70.
Therefore your petitioner asks the court that he may be authorized to pay the said David McDowell the said sum of $32.70 and that he may be authorized to expend the sum of $75 per month for the support and care of his ward and his wife from the time of his appointment to the date of the appointment of a permanent guardian. And he further asks that he may be authorized to deposit the funds in his hands as such guardian in the Montezuma Savings Bank. And for such other and further orders as may to the court seem just in the premises." Signed J. W.Carr, Attorney for said guardian.

There is an inventory form showing that on April 6 1911, Mr. Morton opened an account for $8400.00 at the Citizens State Bank, New Sharon,Iowa.

An invoice in the file dated 25 Aug 1911 from Levi Mincer states:
"For board and care of A J McDowell and wife from Oct 1st 1910 until latter part of March, (about 25th) 1911, at the agreed price of $250.00 for the time specified $250.00
For board and care of A. J. McDowell and wife from April 8th 1911
until August 25th 1911, at the rate of $650.00 per year 250.71
Total $500.71

I hereby affirm that the above account is according to agreement made at time A J McDowell was assigned to our care; this for maintainance."Signed Levi Mincer and notarized by W. H. McNeil.

September, 1911, Term has an Answer. Copy is very faint in places.
"Comes now by defendant, and for answer to the petition filed herein by plaintiff states:
Defendant denies each and every allegation contained in said petition, except that he admits that he is 81 years of age.
Wherefore defendant asks that plaintiffs petition be defeated and that he shall have judgment against the plaintiff for costs." Signed by Bray & Shifflet, Attorneys for Defendant and by A. J. McDowell, notarized by T. J. Bray.

There is a page that says "We the jury find for the defendant." signed by the Foreman.

A Final Report by the Temporary Guardian shows payments, but not the amount billed by Levi Mincer, although David was paid for the trip to Ohio. Showing a balance of $8,128.70. The last document is a hand-written receipt that is signed by A. J. McDowell personally on 28 Sept 1911 acknowledging receipt of the $8,128.70 and discharging the temporary guardian.
