Henry Cromwell Allen

According to H. A. Beckwith's "History of Vigo and Part Counties", Henry also fought in the War of 1812 - but he would have been only 15 years old. Probably meant Peter's brother Nathaniel instead? Beckwith also says he was a sheriff of Vigo Co which is reflected in the Court Records. His uncle Nathaniel was a sheriff back in Ontario Co NY.

This Indenture made this eighteenth day of May in the year of our Lord one thousand eight hundred and twenty two between Peter Allen and Mary his wife of the County of Vigo and State of Indiana of the first part and Henry Allen son of the said Peter and Mary of the second part, Witnesseth that the said parties of the first part as well for and in consideration of the natural love and affection which they have and bear unto the said Henry as also for the better mainainance, support, livelihood and preferment of him the said party of the second part, have given, granted, aliened enfeoffed and confirmed and by these presents to give, grant, alien, enfeoff, and confirm unto the said party of the second part and to his heirs and assigns all that certain tract or parcel of land situate, lying and being in Section Number Twelve of Township Number Twelve North of Range Number Nine West in the District of lands offered for sale at Vincennes and in the County aforesaid to wit: commencing fifteen rods south of the northeast corner of the southeast quarter of said section from thence due west to the west side of said Section, from thence south on the west line of said Section sixty five rods from thence due East to the East line of said Section and from thence North on said line sixty five rods to the place of beginning inclusive containing one hundred and thirty acres. Together with all and singluar the rights, members and appurtenances whatsoever thereunto belonging or in anywise appeartaining and the reversion and reversions, remainder and remainders, rents, issues and profits thereof and also all the estate, right, title, interest, property, possession, claim and demand whatsoever of them the said party of the first part of, in and to the said tract of land and premises and every part and parcel thereof with their appurtenances, To have and to hold the said tract of land and all and singular other the premises hereby, granted and confirmed with their appurtenances unto the said party of the second part his heirs and assigns, to his and their only proper use and behoof forever. And the said party of the first part for themselves and their heirs, executors and administrators do covenant, promise and agree to and with the said party of the second part his heirs and assigns that they are well seized of the premises hereby conveyed as of a good, sure, perfect, absolute, and indefeasible estate of inheritance in the law in fee simple and that the above granted and described premises unto the said party of the second part they the said party of the first part will forever warrant and defend.

Note: This is part of the tract Peter Allen bought from Robert Huggins, 24 Apr 1817. Some of the same was also given to Ira Allen. This gift was a few months prior to his marriage.

Be it remembered that on this day to wit the seventeenth day of May in the year of our Lord one thousand eight hundred and twenty-three before me the subscriber a Justice of the Peace in and for said County personally came the within named Peter Allen and Mary his wife and acknowledged the within indenture to be their voluntary act and deed for the uses and purposes therein contained. And the said Mary being examined by me separate and apart from her husband acknowledged that she signed and sealed the said indenture freely without any coercion or compulsion from her said husband on having the contents of the said indenture made known to her.

p.185. In 1831, two lots were bought at the northwest corner of 5th and Walnut Streets for the Terre Haute School House. A four-room brick school was built. Shares in the venture were $5 each - Henry Allen purchased two shares.

List of persons who voted at an election in Harrison Township, held at the Vigo County Court House, Terre Haute, 1 Feb 1832, includes: Silas Hoskins, Curtiss Gilbert, Peter Allen (probably Sr because Peter Jr was not quite 21), Myron Allen, Henry Allen, Ira Allen.

Date of death given as 13 Jul 1832 or 1834 in the Warde book. Actually in the Probate records of Vigo Co, Henry Allen was assigned the job as Appraisor for an estate as late as May, 1835, and he died prior to Nov of 1837.

27 Mar 1837 Appeal of Church Mattox vs. John H. Watson & Henry Allen. Error in care. Judgment of Circuit Court was affirmed.
p.528 John Burton vs. Ferrin Wilson & Henry Allen. Debt. Defendants came not - found in favor of plaintiff, $111 + $3.66 in damages and cost. There were several other cases against Henry Allen for debt settled in this manner. Undisputed by Allen.
p.560 Vacation, 1837. Church Mattox vs. John H. Watson, Henry Allen & Myron H. Allen. Replevy Bond. 24 Jul 1837. John H. Watson paid & satisfied $57.73, one half part of the costs & fees. Signed: C. Gilbert, Clerk.
Note: A Replevy Bond guarantees the defendant will abide by the decision of the court.

Henry Allen died between May and November of 1837:
Probate Records "Complete Records, Vol 2", p.505 Aug Term 1842.
Samuel Emerson vs. Myron H. Allen & John F. Croft, Administrators of the estate of Henry Allen deceased. Robert Cary & Henry Allen made a promissory note for $272 to Jonathan Osborn. Emerson is asignee of Osborn. Suit was filed May 1837 but before judgement was rendered Henry Allen died. Nov 1837 Judgment ordered by default against said Cary; Cary became insolvent and left the state. The Estate of Henry Allen is solvent. On 24 Nov 1841 the defendants maintained they were not bound. In Feb 1842, the defendants came not and judgment awarded to Jonathan Osborn.

PUBLIC SALE OF TOWN LOT
In pursuance of a decree of the Probate Court of Vigo county, the undersigned, administrators of the estate of Henry Allen, deceased, will sell at the Court House in the Town of Terre Haute, on Saturday, the 28th day of April between the hours of 12 and 4 o'clock of said day, Lot No. 203 with the improvements thereon, situated in said town. The terms of sale will be favorable.

Probate records of Vigo Co show many small payments of debt to Henry Allen. On p.157 of the first Complete Probate Order book is found the final settlement of the estate of John W. Coffee, 4 Oct 1831. Presented to the court in Sep of 1828 was the account of debts including one of $8.56 paid to H. Allen, Shff.
