BENJAMIN BUELL

(1686 - 18 Feb 1723/24)



Benjamin and Hannah both died leaving young children. The Buell book states that the children were brought up by Hezekiah Hutchinson of Hebron, CT, their grandfather - it would seem that Hezekiah was much more likely their uncle - their grandfather John Hutchinson had died in 1719. And the probate files reveals the children had multiple guardians.

-Inventory of Benjamin Buell, late of Killingworth, who departed this life on 18 Feb 1723/4 is in the Probate Packets, Hartford, CT. Includes his lands. Taken 15 May 1724 by Josiah Steevins, John Lane, and Josiah Rossiter. Hannah Buell, Admr. Recorded 5 Oct 1724.
-Hannah Buel, widow, received Administration on the estate of Benjamin Buel of Killingworth, deceased. 5 Oct 1725. David Buell, Security. 1000#'s bond.
Credits and debits to Benjamin's estate were listed by Hannah. Not dated but probably submitted with inventory. There was also a list of children and their ages. Hannah, 14. Deborah, 11. John, 8. Submit, 6. Benj & Mary, 4. Experience, age 1.
-An addition to the Inventory was added 17 Jan 1725/6.
-Distribution of the lands and goods was made to the children by Josiah Steevens, John Lane & Josiah Rosseter. A portion was taken out to answer debts. Apparently their mother was also dead since there is no widow's portion mentioned. Sons received lands while the daughters received household goods and lands. John, the eldest son received a double portion compared to his siblings. Others who received shares were Benjamin, the youngest son. Hannah the oldest daughter. Deborah the second daughter. submit the third daughter. Mary the fourth daughter. Experience the youngest daughter.
-31 Oct 1728. Hannah Buell, minor daughter of Benjamin Buell, made choice of Capt. Saml Buell of Killingworth to be her Gardian. Deborah Buell, minor daughter of Benjamin Buell made choice of her uncle David Buell to be her Gardian.
-1 Nov 1728. David Buell received Administration on the estate of Benjamin Buell, late of Killingworth. Saml. Buell, Senr, his security. 1000#'s bond.
-Undated account of expenses of David Buell, admin of the estate of his brother, Benjamin Buell
-1 Nov 1728 David Buell made bond as guardian of Deborah Buell, minor daughter of Benjamin Buell, late of Killingworth, dec'd.
-19 ?Feb 1729. Capt Saml Buell & Josiah Buell, both of Killingworth appeared before the Court of Probate in Guilford and made oath they this witnessed Deborah Buell make David Buell her gardian.
-14 Mar 1729. Josiah Buell of Killingworth has received of David Buell, Admin of the estate of Benjamin Buell, all that part or share of Experience, the young daughter of Benjamin, it being 84#'s 13 sh. As Guardian to Experience. Signed: Josiah Buell. Elisha Willcoks and Jedidiah Buell, witnesses.
-20 Mar 1729 Saml Buell, Senr has received of David Buell, Admin of Benjamin Buell all that share of Hannah, the oldest daughter of sd Benjamin, 87#'s, 13 sh, as guardian to sd Hannah. Signed: Saml Buell, Senr. Samuel Buell, Jedidiah Buell, witnesses. One the same day he also received the share of Mary, the 4th daughter, in the same amount, as her guardian. Also for Submit, the third daughter of Benjamin Buell.
-15 Dec 1729 Deborah Buell being of age to chuse a gardian freely make choice of Mr. Moses Huchison of Hebron, her mother's brother to be her gardian and take charge of her person and estate until she reaches full age.
-Hannah Buell, daughter of Benjamin & Hannah Buell, late of Killingworth stated her honourable uncle Capt. Samuel Buell of Killingworth was guardian and took charge of her estate while she was an ophan. On 20 Apr 1730, she received of sd Samuel Buell her full portion or right of inheritance and acquit & discharges him. signed: Hannah X Buell. wit: Ebenezer Crane, Anna Crane.
-31 Jan 1743/4 Experience Buell received of her guardian, her brother John Buell all that part of her father's estate and discharged all demands. Signed with her mark. Benj Merrell, Saml Willcocks 2nd, witnesses.
-19 Jun 1738 Benjamin Buell, age 16, believing that his brother John Buell would be more likely to serve as his guardian, makes choice of John Buell, dismissing his uncle Hez Hutchason formerly his guardian.
-21 Jun 1738 John Buell, son of Benjamin Buell, dec'd, discharges his guardian,his uncle ?Willm Buell. (much too faded to read)
-18 Sep 1738. Josiah Rosseter gives opinion of the worth of a tract of meadow let to Submit Buell would be worth by the year. Saml Buell, gardian to Submit has had the benefit of improvement for nine years. It would have let for $20 per year. It lists for one and a quarter acres, but he thinks it is at least two and half acres and would yield good redtop hay.
-There is an account of charges, etc. from the guardian of Submit Buell. Undated and not signed. On 13 Mar 1739, Submit Buell received in full her dowry of her father's estate from her kinsman, Samuel Buell her Guardian, and he was discharged.
-18 May 1740 Mary Buel received the full portion of her father's estate from her guardian, Mr. Daniel Buel of Killingworth and do hereby acquit & discharged my guardian from any further claim. Signed with her mark. James Hill, Henry Hill, witnessed.
-21 June 1740 Letter from Henry Hill, Clerk to Mr. Benjamin Merrell of Killingworth. Josiah Buell, late of Killingworth, decd was Guardian to Experience Buell, minor daughter of Benjamin Buell and gave bond dated 1 Nov 1728 to faithfully discharge all duties and he rec'd the portion of the estate belonging to sd minor, receipt dated 17 Mar 1729. He died having first made his will & appointing his wife Martha his Executrix whereby she became seized of the estate of sd minor and was appointed Guardian to sd Experience and gave bond 28 Nov 1732. Since that time she, Martha, married with you whereby you became seized of the minor's estate together with your wife. Your wife is since dec'd leaving you still seized of the estate of sd minor. Experience has made choice of her brother John Buell to be her guardian which was allowed in court and sd John gave bond. ;Experience has made complaint to the Judge of the Court of Probate that you, Benjamin Merrell, has refused to render to John Buell the just account of goods and estate belonging to sd Experience. You are to appear before the Court to render an account of said goods and estate on 7 July next at three in the after noon, to the satisfaction of her guardian.
-7 Jul 1740 (nearly unreadable) Benj Merril of Killingworth has been guardian to Experience Buell through his late wife Martha who was her guardian, is apparently answering a complaint of John Buell. A colt belonging to Experience had died. Merrill gives account of expense - as apparently ordered by the court.
-15 Mar 1742 Saml Hill of Guilford appointed John Buell of Killingworth, guardian to Experience Buell, his attorney to represent him in the court of probate. (I never figured out why)
-A note in file is surely that of his son, Benjamin: Benjamin Buell of Hebron, Hartford Co appointed his brother John Buell of Killingworth in New London County his attorney to appear and act in all respects before the Court of probate at Guilford. Dated 14 Nov 1749.
Difficult to read - back of above note. Dated at Guilford, 13 Apr 1750. John Buell on behalf of Benj Buell appeared with Josiah Buell, admr of the esatate of Majr. David Buell, late guardian to Benjamin before the court of Probate.. I believe John Buell was given guardianship and posted bond.



According to Goodenough his gravemarker in Indian River Cemetery (also called Clinton Cemetery) in Clinton, Middlesex Co, CT gives date of death as 1723 which would be correct in old style dating.
A picture of his grave marker on FindAGrave has the inscription:
"Here lyeth the body of Benjamin Burll who departed this life Feb'y 18th 1723/4 in the 38 year of his age."
