Ely wrote his will 2 Jun 1842 and it was proven Feb 1843. He named his wife and children, Nancy, Joseph John, & Martha Elizabeth, and appointed his son Joseph and son-in-law Henry Hyman as executors. Ely died 6 Feb 1843.

Martha wrote her will on 6 Apr 1845 and it was proven Nov 1845. She named her three children and granddaughters Ann F. & Martha S. Hyman. [Children of daughter Martha.] Son Joseph was executor or in his place, nephew Robert H. Austin of Tarboro who was to be trustee for daughter Martha and her children.

Ely & Martha are buried in the Primitive Baptist Churchyard in Tarboro.
