Know all may by these presents, that John Bailey and Nancy Bailey my wife and John J Goheen their said legalees named in the last will of Joseph Goheen late of Ferguson Township deceased do hereby acknowledge that we have this day had and received of Robert Goheen Executor of the last will and testament of the said Joseph Goheen deceased the Sum of five thousand and Seventy three dollars and ninety four cents in full satisfaction and payment of all such sum or sums of money legacied an bequests as are given to and bequeathed to the said John Bailey, Nancy Bailey and John J. Goheen by the last will and testament of the Said Joseph Goheen, and all interest accrued thereon. And therefore the said John Bailey and Nancy his wife and John J Goheen, do by these presents, release acquit, and forever discharge this said Robert Goheen his heirs executors and administrators of and from the said legacy of legacies, and of and from all actions, suits, payments, accounts, reckonings, claims and demands whatsoever for or by reason Thereof or of any other act matter, cause or thing whatsoever from the beginning of the world to the day of the date of these presents. Goheen late of Ferguson Township One of the sons and legatees named in the in the last will of Jospeh Goheen, late of Ferguson Township aforesaid deceased as hereby acknowledge that I have this day had and received of Robert Goheen Executor of the last will and testament of the said Joseph Goheen deceased the Sum of twenty five hundred & thirty six dollars and ninety seven cents in full satisfaction and payment of all such sum or sums of money legacied release acquit, and forever discharge this said Robert Goheen his heirs executors and administrators of and from the said legacy of legacies, and of and from all actions, suits, payments, accounts, reckonings, claims and demands whatsoever for or by reason Thereof or of any other act matter, cause or thing whatsoever from the beginning of the world to the day of the date of these presents. Be it remembered that I Robert Goheen of Boalsburg Centre Co Penna being of sound and disposing mind memory, and understanding, and considering the uncertainty of life, do therefore make, ordain, publish, and declare this to be my last Will and Testament, in manner and form following the is to say:Imprimis:
I direct that my body be decently interned in the burial ground at the Branch church and that my funeral be conducted in a manner corresponding with my situation and condition in life. As to such estate as it hath pleased God to intrust me with I dispose of the same as follows, Viz: I give and bequeath unto my three daughters Almira Goheen, Margaret Jane Goheen, and Lucretia Davis Goheen the sum of One thousand dollars to be equally divided amongst the three, as soon as that amount can be realized from my estate. The above mentioned one thousand dollars is to be in addition to the full and equal share of these three daughters to the rest of my estate.
I also give and bequeath unto my above mentioned three daughters the following personal property; each being the owner of one third the value thereof, and which they are also to receive in addition to their equal share in the rest of my estate. - Viz: All my household goods, including beds and bedding, carpets, chairs, stoves and fixtures, all kitchen furniture, and all and every kind of property whatsoever, found in my house from cellar to attic at the time of my decease. Also all tubs, barrels, garden utensils, including grubbing - hoe shovel and manure fork. Also my carriage with tung and shafts, together with Robes blankets and whip. Also their own selection of any horse I may own at the time of my decease, together with my best set of single harness and fly net. Also their own selection of any two cows from the herd. Also three hogs or shoats. Also three sheep. Also each year as long as the farm where I now live remains unsold, the aforementioned three daughters shall have out of the estates share of the products of the farm, Three loads of good hay, and two loads of topped corn-fodder put in the barn for their use, and all the straw they may need. Also they shall have good and convenient stable room for their stock, with halter and chains. Also each year 25 Bus wheat, 150 Bus corn ears, 75 Bus oats, and 20 Bus of potatoes, Also all the flour, meat, and fuel on hand at the time of my decease. Also all the wood they may need each year from my land on the mountain. Also pasture for their stock if they require it. Also under any arrangments my three above mentioned, daughters to retain possession of the parlor end of the house where we how live, both up stairs and down, with the use of half the garden, and full and free use of the cisterns, also half the room in my shop for purposes of family work. Also all the fruit they may need, both of apples and small fruits. If the farm where I now live be rented it shall if possible be upon these conditions - The tenant to occupy that part of the house not reserved for my daughters. He (the tenant) shall give one third of the whole of the products of the farm, grain, hay, fruit and pay all taxes. He shall haul the firewood and coal for my daughters without charge. He shall haul the rails, and keep the fences in repair without charge. I also make the following special bequests. - To my daughter Almira I give my watch and chain. To my daughter Margaret Jane I give one hand-saw, one 2 ft rule, one square, pair dividers, Brace and bits, one plane, three chisels, Hammer and hatchet. To my daughter Lucretia I give my shot-gun, pouch, bullet-molds, Shot-bag and powder-horn. To my daughter Margaret I give the grind-stone, and good axe. I give and bequeath to my above mentioned three daughters, all the fowls on the farm at the time of my decease.
And as to all the rest, residue, and remainder of my Estate, real personal, or mixed, of whatever nature or kind, or wheresoever situate t the time of my decease. I do hereby give, devise, and bequeath unto all my seven children, share and share alike. It is my will that the farm now occupied by my son William M. be sold if possible within two years from the time of my decease and out of the proceeds of that sale, the mortgage on that farm be paid. I also direct that the farm where I an my daughters now live shall not be sold for five ears after my decease, unless by the unanimous consent of all my children, they should decide that to sell within five years would be to the advantage of them all.
And lastly I do make, constitute, and appoint my daughter Margaret Jane, and my son William M Goheen to be the executors of this my last Will and Testament, hereby revoking all former Wills by me at any time heretofore made, and declaring these presents only to be and contain my last Will and Testament
In witness thereof, I have hereunto subscribed my name and affixed my seal, the twelfth day of September in the year of our Lord one thousand eight hundred and Eighty Seven.
