Tabitha Miller

(Ca 1834 - 20 May 1912)

If Tabitha's parents are as shown on FamilySearch, she and her husband were first cousins.

1910 Census. Prec 4, Chilton, AL
William R. Baker, 22, married 1 time for not yet a year
Etta, wife, 15
Tobitha Mims, 81, widow [appears to be list as f-law when it probably should have been mother-in-law]

Tabitha Miller was born in October of 1829 in Alabama. It is rumored that she was 1/2 or 1/4 Native American. Her parents are unknown to me, but I do know from census records that her father was said born in Alabama and her mother was born in South Carolina. Direct descendants that have had autosomal DNA testing from this line, show no Indian heritage - and this is likely the usual tradition that proves to be flase.

Tabitha's estate settlement 1912-1913, is found on FamilySearch.org in the Alabama Estate Files. She died without a will leaving a number of heirs, 35 in all, to include great-grandchildren whose parent and grandparent had died before Tabitha. Her land was sold for distribution - it was the SW 1/4 of the NE 1/4 of Section 5, Gwp 21, Range 15 (probably 40 acres). The land sole for $1000 and after paying all costs, attorney's fees, etc. there remained about $900 to be divided - living children received $69.66 each - that amount was then divided among the heirs of the deceased children.

A guardian was required for the following minors:
William Moses Easterling, only child of Charlotte (Mims) Easterling, daughter of William. M. Mims, deceased (great-grandchild of Tabitha)
Fannie Bell, Sam Paul, and Lona Mims - minor children of William M. Mims (grandchildren)
Essie, Minnie, Whit & Jodie Mims - minor children of Elijah James "Bud" Mims, deceased (grandchilren)
Dewey Powell, only child of Rosa (Mims) Easterling, daughter of Penny (Mims) Mims, deceased (great-grandchild)
Mamie & Enoch Easterling, children of Sarah "Sallie" (Mims) Easterling, daughter of Penny (great-grandchildren)
Carl Baker, only child of Missouri (Mims) Baker, daughter of Penny (great-grandchild; Missouri was called Virginia in early census records - it is unknown if she was Missouri Virginia Mims or Virginia Missouri Mims.

Two of the children of George & Tabitha had died young - the oldest, Fereba Jane, and the youngest, Edward, leaving thirteen children either living or with living heirs. Living children were:
Syvilla Robinson, Mahala Robingson, Eliza Baker, Rosa D. Baker, Delilah Baker, Virginia Wyatt, J. A. W. Mims, and H. M. F. Mims. The deceased children were Tabitha Baker, W. M. Mims, E. J. Mims, and Pennie Mims.
Tabitha left only one child - Jesse Baker - who was the guardian for the above minors. He received her full share.
William Moses Mims left five living children. Two were of age: Theresa Duke and Mardrue Robinson. Three were minors - the above Sam Paul, Fannie, and Iona. One of his children, Charlott (Mims) Easterling had died leaving her son William Moses Easterling. Each of his children, and the young grandson, received one-sixth of his share.
Elijah James Mims was deceased leaving eleven living children. Essie, Mamie, Whit & Jodie - all minors as above. And W. P. Mims, Lula Johnson, B. E. Mims, M. L. Mims, G. M. Mims, Tommie Mims, and Diska Cleckler. Each child received one-eleventh of Elijah's share.
Penny Carolyn (Mims) Mims was deceased. She left five living children: J. W. Mims, E. P. Mims, G. N. Mims, Mahala Maddox, and Janie Johnson. Three of Penny's daughters had died. Sarah "Sallie" (Mims) Easterling had died leaving two children, Mamie & Enoch Easterling. Rosa (Mims) Powell was deceased, leaving one son, Dewey Powell. Missouri (Mims) Baker had died leaving one son, Carl Baker. Her children each received one-eighth of her share - Dewey Powell and Carl Baker each received their mother's one-eighth share. Mamie and Enoch Easterling equally divided their mother's one-eighth share - they actually received $4.35 each.
