John Ashley

Served in the War of 1812, Capt James' Co, Kentucky Militia from 1 Sep 1812 to 30 Mar 1813. John applied for his bounty land, 1850, and included a copy of his discharge. He was award two 80 acre tracts.
Elizabeth Ashley, widow of John Ashley applied for pension, 13 Nov 1871 from Scott Co, IL. She included a copy of their marriage record - John Ashley to Betsy Montomgery, June 26, 1813.

John Ashley was the only Ashley male in the county: 2m age 5-10, 2m 10-15, 1m 30-40; 3f under 5; 1f 30-40.
The Casey Co, KY 1840 Census had three men named Ashley, all counted on the same page.

[Elizabeth would have been about 46 when Sarah was born - just possible.]
10 Nov 1850 John Ashley petitioned for his bounty land for service in the War of 1812. He was age 56, a resident of Adair Co, KY and served under Capt James Kennedy in the 2nd Regt Kentucky Volunters commanded by Lt. Col. W. Jennings in the War of 1812. He entered service in Aug of 1812 and served seven months, honorably discharged 9 Mar 1813 as appears by his original certificate. He makes this declaration for the bounty land passed by Act, dated 18 Sep 1850. He signed with his mark. Eli Wheat, Esq, (Justice of the Peace) testified to his identity.
Copy of his discarge was enclosed, signed by James Keneday, Lieut. Comd.

I did find online a reference and transcript to a Commissioner's Deed, 29 Mar 1865, presumably in Pulaski Co KY - a division of lands resulting from a suite among the heirs of John Ashley. John O. Ashley was administrator of John Ashley who had died in 1857. Heirs were Uriah, Robert, and Montgomery [James M.], Ashley; C. P. Miller & wife Emily, dec'd; William Adams & wife Eliza, dec'd; William Wilson & Mary, dec'd; Obed Bolinger & Minerva, dec'd; Aden, Sarah, Thomas & John Ashley, the last two being infant heirs. [Son Obediah does not appear in this list of heirs, and I have not found him in 1850 so he could be deceased and could have had sons named Thomas or John. The son Thomas, age 11 in 1850 is also not in this list. However, this deed would seem to prove conclusively that Aden's father was John; his older brother, Uriah. One very puzzling thing is finding all the daughters "deceased" - I very much suspect that were listed as being "late ___ Ashley" which meant they had married, not that they were dead. Certainly daughter Elizabeth who married William Adams was still living in Pulaski Co in 1870. The others have been more elusive in the censuses.]

Miller and Emily, his wife, late EMILY ASHLEY, William A, Adams and Eliza, his wife, late ELIZA A. ASHLEY, William B. Wilson, and Mary, his wife, late MARY ASHLEY, Obed J. Bolinger and Manerva, his wife, late MANERVA ASHLEY, ADEN J. ASHLEY, SARAH ASHLEY, THOMAS ASHLEY and JOHN ASHLEY, the last two being infant heirs, by Eben Milton, Commissioner of Pulaski Circuit Court of the first part, and Monroe Surber of the second part - Judgement rendered in suit of JOHN O. ASHLEY, administor of JOHN ASHLEY, deceased Plaintiff, against parties of the first part, in which it has claims against the estate. Land to be taken from the East side of tract of land in Pulaski County.
16 July 1871. Aden J. Ashley, Comodore P. Miller and Eliza A. Miller, deposed that John Ashley died 17 Mar 1858 from typhoid, in support of Elizabeth Ashley pension claim based on John's War of 1812 service.
