In the name of God, amen, this the last will and testament of Alexander Marshall of Prince Edward County Virginia.
Item: my will is that all my just debts be paid.
Item: My will is that my executors herein after named do hire out privately to such persons as will treat them with humanity the following negroes to wit Caesar, Nancy, Joe, John, Davy, Sally, Diley, Elizabeth, Effy, Isaac and James Henry (eleven in number) and the money arising from the hire of said negroes, after my debts are paid to given to my daughter Sally Owen during her life, but should my daughter Sally Owen die before her husband William Jack Owen, the hiring out of the said eleven negroes together with their future increase to be continued during the said Wm. J Owen life, and the money arising from the hire of said negroes from the death of my daughter Sally to the death of said Wm Owen to be put out at interest and at the death of said Wm J Owen the said negroes and their future increase together with all money that arise from their hire and interest there on to be equally divided between the surviving children of my daughter Sally Owen together with the heirs of all such as may be dead, but should my daughter Sally Owen be living at the time of the death of her husband Wm Owen in that event I give and bequeath to my daughter Sally Owen the above named eleven negroes, together with their future increase and all money that be due for their hire to her and her heirs forever.
Item: I give to Abner H. Burks, the son of Abner H. Burks deceased, two negroes (to whit) Daniel Walker ad Caroline when he becomes of age the said two negroes I leave in the care of Armistead Bruce to manage them as he thinks most advantageous for his nephew Abner H. Burke.
Item: I give to Ann M Burke the daughter of George F. Burke one negro girl named Harriett when she becomes of age or married but should Ann M Burke die before she becomes of age or marries then the said negro Harriett and her increase to be equally divided between all of George F. Burke's children.
Item: my two negroes Bridet and Jack (her son) shall be hired out every year, they choosing their master or mistress and the money from their hire shall be give unto them, also I give Bridgett the sum of twenty five dollars annually as long as she shall live the money to be raised out of the sale of my perishable property if enough after the payment of my just debts, if not a sufficiently shall be made up out of the hire of the eleven negroes above named and the money arising from the sale of my land herein after named, each to pay the one half of said deficiency  (if any) should there be any money arising from the sale of my perishable property left after the payment of my debts and giving Bridget twenty five dollars annually as above named. I give the said surplus to my grandson, Noel Waddill.
Item: My wish is that all my land be by my executors sold (except a half acre to be reserved around the grave yard wherein my last wife is buried) my land may be sold all together or in parcels and upon
such credits not exceeding four years for the last payment as my executors may think will advance the interest sale thereof and the money arising from the sale of the same I dispose of in the following manner (to wit) one third to my son Walthall Marshall the remaining two thirds I give as follows one fourth to my granddaughter Patsy Akin the daughter of Patience Akin (deceased) provided she is living when the money becomes due if she is not living at that time, then the money is to be equally divided between Noel Waddill and his sister Nancy Walters. To Rhody Ligon or her representatives I give one fourth to Richard Marshall or his representatives, I give one fourth to Charles Waddell or his representatives I give the remaining fourth. My will and desire is that none of the legates in this will shall be compelled to give security for their parts of my estate as herein before named as most of them live at a considerable distance.
Item: my will and desire is that Wm J. Owen shall not directly or immediately here or have any control over any of the above eleven negroes that are to be hired out for the benefit of my daughter Sally Owen.
Lastly, I nominate constitute and appoint my true friends Simeon Walton, John Foster & Alexander Marshall executors to this my last will and testament hereby revoking and making null and void all former wills by me made. In testimony whereof I have hereunto let my hand & affixed my seal this first day of December in the year of our Lord eighteen hundred & twenty eight.

At a court held for Prince Edward County July the 20, 1829, the last will and testament of Alexander Marshall decd. was presented in court and proven by the oaths of Henry M. Jenkins and John Rudd for two witnesses thereto ordered that the same be recorded. On the motion of John Foster executor herein named he with Simeon Walton, Nathaniel Jackson, Thomas E. Hakins and Jon Clark his securities interest unto me acknowledged their bond for the purpose in the penalty of eight thousand dollars conditioned according to law and took the oath required by law certificate for obtaining a probate thereof due from is granted him.
