James Paine was remembered in the 1705 will of his father. Col. John Thacher of Yarmouth, by will of 25 April 1713, bequeathed to daughter Bethiah Paine, James wife, "besides what I have formerly Given her mr Perkins 2d volum or booke and also Ten shillings of my Estate." James Paine was admitted a townsman in 1689 at Barnstable where he was active as schoolteacher, miller, cooper, soldier, and clerk. He served as a military clerk in the 1691 expedition against Canada, and his heirs received therefore in 1736 a grant of land in Maine.
Letters of administration were issued in the estate of Mr. James Paine of Barnstable to Mrs. Bethiah Paine and Mr. Thomas Paine 20 January 1728. Thomas was named substitute administrator of the estate of Thomas Crocker, succeeding his father James on 21 January 1728. Settlement of the estate of James Paine occurred 31 October 1729 when Thomas Paine, Bethiah Paine, Mary Freeman and Experience Hunt, his children, entered into an agreement with widow Bethiah Paine. Samuel Hunt, husband of Experience, also signed.
The will of Bethiah Paine of Barnstable, dated 4 September 1733 and proved 31 July 1734, mentioned son Thomas, three daughters Bethiah Paine, Mary Hawes, and Experience Hunt; grandaughter Rebecca Hunt and grandchildren James Freeman and Bethaiah Freeman. An inventory, dated 7 October 1734, was sworn to by Bethiah Russell 22 May 1742. The undated account mentioned Dr. Russell, Sister Hawes and Brother Haws. Receipts were given by Edmund and Mary Hawes, 7 October 1734; Samuel and Experience Hunt, 1 August 1734; Samuel Hunt of Weymouth, 16 December 1734, and Thomas Paine, 20 December 1734; the Hunts again, 10 November 1734; John and Bethiah Hinckley 11 March 1745, and James Freeman, 12 November 1747.
