John Brawner
(4 Apr 1723 - Bef 6 Mar 1798)
Notes:
Written by Norma Fiske Lundgren in response to a query on John Brawner.
The John you have as the son of Henry/Elizabeth Barton--that is my John, I think--except I think he was the son of Edward Brawner (usually given as married to Anna Ball) and his first/second wife. I strongly suspect that the old bible with the 1743 date was read incorrectly--very easy to do! I cannot find the people who had the bible nor copies of it. A John Brawner gave three depositions in Charles County that place his birth year as 1723, one of which he identified himself as the son of Edward. In addition, Mary (Brock) Brawner speaks of "my grandson" John Broner, son of "my son" Edward Broner in her 1727 will. He would be the brother of your Henry (married Elizabeth Barton), sons of Edward/Anna Ball. John inherited Hopewell and added to it by 41 acres, called "Brawner's Addition". In Charles County, he signed or is listed on: Land Grant 1750, Will of Edward Brawner 1767, Deposition 1769, Land Grant 1769, Court case 1769, Depositions (2) 1777, Deposition 1778, Continental Census 1778, 31 Dec 1780 Will of William Brawner, Sr.; Land Tax list 1783, Personal property Tax 1783, Deed 1788, 1790 Continental Census taken 1791, Will of Cloe Farnandis 1795 (he or son John), (I made a distinction between John, John Jr, and John C. Noted that John, Sr. is NOT on the list of men between the ages of 16 and 45 taken 1776 (making his birthday before 1731) but John Jr. is. I think his son John (Jr.) joined the Continental Army in 1776 and sold his part of Hopewell to Thomas Mitchell in 1803). John Sr. died leaving a will, written in Charles County 31 Jul 1797 proved 6 Mar 1798, William Brawner next of kin, Henry Brawner executor, naming his wife Elizabeth and his son Henry, and saying he wanted his property divided equally between his children, not named. At that time, I think he was living on the 41 acre additon, and John Jr. and Henry had split Hopewell and the 50 purchased acres between them, each having about 75 acres, but I need to see more land records to be sure of this.

William Smallwood of CC, wanting to perpetuate the testimony of sundry witnesses respecting the title of the following tracts of land called Allansons Folly and Saint Davids, for which actions of ejectment have been brought and are now depending in the General Court of Maryland between Thomas Rookwoods, lessee, plaintiff, and John Brawner and William Jones, tenants of sd William Smallwood, gave the following notice to William Cooke of Annapolis, the Atty at Law for sd Thomas Rookwood, he, sd Rookwood, being absent and residing out of the State of Maryland-to wit
Sir,
I hereby give you (as atty for Thomas Rookwood) notice that, on Jun 2, 1789, between 8:00 AM and 6:00 PM, at Chickamuxon Warehouse on a tract called Allansons Folly in CC, I intend to take the depositions of witnesses, and that on Jun 3, 1789, between 8:00 AM and 6:00 PM, I intend to take the depositions of John Mackatee, Giles Green, John Brawner, Henry Haislope, and Mrs. Alice Nelson at their dwelling houses respectively. And also that on Jun 4, 1789, between 8:00 AM and 6:00 PM, that I intend to/take the depositions of Richard R. Reeder, Mrs. Reeder, the mother of the sd Richard, Walter Hanson Sr, Mrs. Priscilla Franklin, and William Franklin Sr at their dwelling houses respectively. These depositions will be made use of against sd Thomas Rookwood in an action of ejectment brought by him against John Brawner, my tenant, for a tract of land called Allansons Folly, and also in another ejectment brought by him against William Jones, my tenant, for a tract of land called Saint Davids, and also to show that sd Thomas Rookwood to any lands which I claim. Signed-W. Smallwood. To William Cooke, Esq, Atty for Thomas Rookwood. May 10, 1789.
To which notice there is the following receipt and proof. On Jun 2, 1789, came Daniel Jenifer, Esq, before me, and made oath that he left the original notice with William Cooke, Esq on May 12, 1789, and that at the same time, sd Cooke gave him a receipt acknowledging receipt of the original. Signed-Richd Barnes*. Recorded Sep 3, 1789.
No. 14. The deposition of John Mackatee, aged 83 years, says he was well acquainted with old Edward Rookwood's son, Thomas, and that Edward died some years before Thomas. Thomas lived on the hill above and on the plantation whereon Chickamuxon Warehouses now stands, that he married Henrietta Barnes, the daughter of old Henry Barnes and sister to James Simmes' wife, that Thomas held, some years after the death of his father, and always lived on sd plantation at Chickamuxon and died there seised, and in possession of the same tract of land, and a tract called Hard Frost, and another tract whereon Edward Maddox lived, and another tract now held by the heirs of old William Brawner, and that all these lands, upon his death, descended to his surviving daughter, Ann. The land became escheat. Before Ann's daughter, Charity Moore, was born, sd Ann, being a wealthy woman, people used to talk of her dying and that.they would escheat all her lands, particularly Mr. David Stone said he would escheat them, but that Henry Moore escheated the lands. This Deponent further says that old Mr. John Franklin told him that the person who called himself William Rookwood and who lived in Virginia, was not old Edward Rookwood's son, but one, Goslin's son, and adds that John Franklin afd lived with Edward Rookwood. Signed Jun 5, 1789-John (JM his mark) Mackatee. Wit-Dan Jenifer*. Recorded Sep 3, 1789.
The 1790 Charles County Census has been added to our census database. This census was transcribed by Ann Langley-Striegel from actual images of the handwritten census. Recorded 28 Apr 1791 by Charles Mankin Assistant to the Marshall of Maryland.
