Charles Proctor

(Bet 1785 and 1790 - 1835)



The Will Books of Logan Co KY mention multiple Charles Proctors. Charles Y. Proctor was the son of a John Proctor who administered his estate in 1828. Hezekiah's will in 1830, named his son Charles. Benjamin's last codicil was in 1851, and he also had a son Charles, still living.

1813 Logan Co Tax list - the first time a Charles appears - he paid tax on 300 acres on the Gasper River in Logan Co that had been entered by J. McCutchen - the deed for this property appears not to have been made until 14 Nov 1820 (see later). He had three slaves and two horses. This is the only Charles known to be Logan Co that would be this age - and he had married in 1811. He continued to pay tax on this property until 1824, when his half-brother James purchased the property for debt - but James, in his will, left it to Charles and his wife for their lifetimes, then to be divided among their children.

1820 Census shows both a Charles & George to be between 26-45 and enumerated next to each other:

Note: this is close to the same acreage that will ultimately be divided among the heirs, when Charles's wife dies.

It appears that Charles, had financial issues - perhaps even health issues. Certainly he had deaf children. The tax records show that in 1823, Charles owned as much as 309 acres on the Gasper River - that had been entered by James McCutcheon, but sold to Charles by Thomas Proctor in 1820. By 1824, Charles had only 140 acres - and thereafter appears with no land at all. Charles had also owned two slaves and they disappear as well. In 1824, Charles' property had been sold for his debts and his brother James had purchased it. The 1829 Logan Co tax list included a column for the number of children ages 4-14 and Charles had seven. In 1836 there is an entry for Charles Proctor's heirs and lists 340 acres on the Gasper- Charles's wife Elizabeth appears as a widow in the 1840 census. James had died in 1835, and Charles and Elizabeth were to have the right to live where they were living for their lifetime with the land to be divided among their children - based on the later division, this seems to be that property that James bought, then left to his half brother Charles and family.

The 1829 Logan Co tax list included a column for the number of children between ages 4 and 14 in the household - Charles listed seven, very close to the ages I've determined for his children.

Charles Proctor, next to George, two more households is Hezekiah.
2m -5, 1m 5-10, 2m 10-15, 1m 40-50. Charles had five sons born before 1830 - John T. perhaps born that year. Their exact ages unknown, but this census is certainly approximate.
1f -5, 3f 5 -10, 1f 40-50. 2 Slaves. The daughter under 5 was Martha - the other three daughter Elizabeth, Rebecca and Mary. The age is correct for the widow Elizabeth in 1840 and 1850.

Charles Proctor: 1 white male over 21, 1 slave over 16, 1 slave total. No land noted.
[The will of Charles half-brother, James S. Proctor, makes a provision for Charles and his wife to continue living where they were at that time. It appears Charles may have lost his land due to debt and be living on property belonging to a brother, see earlier note.]

Also on the 1820 tax list, there was a younger Charles Proctor who isn't placed in a family - he was listed as a white male over 21, but had no personal property or real estate and doesn't appear in the census as a head of household. Born by 1799, he doesn't seem to figure in any of the known Proctor families.

Benjamin Proctor had a son Charles, born 1806. His Charles Proctor married Lucy Jane Watson, 12 Sep 1844
A Charles Proctor married Sarah E. Robenson, 18 Jun 1852; he was a son of this Charles and born about 1824.

The Logan Co Tax list, 1836, has an entry for Charles Proctor's heirs and lists 340 acres on the Gasper. This would seem to be the land left in trust by his brother James. Charles's wife Elizabeth appears as a widow in the 1840 and 1850 census. Their children are listed as siblings in the will of son William in 1848 - he also named Elizabeth as his mother.
