Estate File of James Critcher, 1815
James had been involved in a lawsuit over payment of a stake (bet) of $500 on a horse race for several years when he died and the suit continued under the auspices of his executor Stephen Sneed. There is a copy of an agreement 24 Dec 1799 between George Parker & James Critcher - the race to be run the first Thursday in May next, one quarter of a mile. Also a copy of a bond signed by George Parker for the $500. There are so many depositions from the judges, spectators, even the riders of the horses (the deposition of Critcher's jockey was taken at the French coffee house in New Orleans), subpoenas, pay tickets, etc. that two folders were used. Many of the documents are illegible due to poor handwriting/bleed through of heavy ink. Some of the testimony had to do with the usual customs regarding horse racing. The race took place in May of 1800, at Thomas Rice's paths between mares belonging to James Critcher and George Parker. Parker's mare had refused to start - Critcher's horse ran alone and passed the finish line. Parker then refused also to pay - much of the dispute had to with whether or not Crutcher's rider had then gone back and weighed in again, but some of the testimony indicated that they had agreed before the race that weigh-in would not be required at the end of the race. Others testified that Parker had been told this mare would sometimes fail to start. In later years the suit was against Thomas Taylor - perhaps Parker had died and Taylor was his estate administrator. The case was apparently for naught.
Supreme Court, Raleigh, NC. July Term 1818. James Critcher's Admr vs. Thomas Taylor, Granville
This case is dismissed by the plaintiff's Counsel from the Docket of this Court.
There was nothing else in the file regarding settlement of the estate of James Critcher - it was all about this lawsuit.
