A 1795 Chancery Court Case file by Isham's brother David reveals that Isham was deceased. He obviously died without issue, although he was guardian for David, Nancy and Molly from 1772 and for the next seven years. It has been supposed these were a nephew & nieces, children of his brother James who married Mildred Mims, but this is not proved and various testimony indicates these children were older than those of James & Mildred and were more likely the children of James & Rachel Haden Johnson.

David Johnson, Senr, administrator of Isham maintained that Isham Johnson had signed property over to David Johnson Jr but then wrote a will that distribute the property differently
Agnes Johnson, sister to Isham, testified during the Chancery case that Isham died on 22 Sep in 1794 and was buried the following day. She denied any knowledge of a will. She was living with Isham at the time. She also claimed to have no knowledge of any guardianship papers in regard to David Johnson Jr.

David Johnson Jr. testified saying that he had given to David Johnson Sr the deeds signed by Isham and that he was not claiming any property. He also stated that in 1779 & 1780 he had made contracts with his sister and another sister's husband to settle a portion of his father's estate in return for their agreement to release Isham Johnson from any claims against as their guardian. David Jr knew of no will written by Isham Johnson. In return for his board, David Jr had labored for Isham without pay.

In the testimony of Jacob Johnson, son of Drury Johnson, dec'd, Jacob claimed that he had heard Isham say he did have a will in which he gave his land to James Johnson, son of David Johnson Sr, but he should give his land to David Sr. There was some indication that David Sr had offered Jacob a mare in return for his disposition. Probably David Johnson Sr had brought this suit in order to be sure his James received Isham Johnson's land. David Johnson Sr himself died before the suit was settled and Isham's estate was distributed to all the heirs.

In 1798, a sale of Isham Johnson's estate was reported to the court, David Johnson [Sr] was administrator. Purchasers included David Johnson Sr, Jacob Johnson [son of Drury, Isham's brother] William Johnson [probably a son of David Sr] and Agnes Johnson [Isham's unmarried sister].
There was a division of Isham's property on 20 Nov 1801, Goochland Deed Book 18, which divided his estate in seven parts among his siblings or their heirs. These were the representatives of [1] Mary Turner, late wife of Bartholomew Turner, sister, dec'd; [2] Drury Johnson dec'd, [3] James Johnson, dec'd, [4] David Johnson, dec'd; [5] Sarah Sampson, dec'd, late wife of Stephen Sampson; [6] Benjamin Johnson; [7] the claimants under the will of Agnes Johnson dec'd. Rec. 21 Jun 1802.

The Commonwealth of Virginia to the sheriff of Goochland County greeting. You are hereby commanded to summon William Johnson, admr of David Johnson dec'd and the said William David, James, Lucy, Sucky and Betsy Johnson, distributees of the estate of the said David Johnson dec'd and Bartholemew Turner and James, Henry, Charles, Pleasant & William Turner, legal representatives of Mary Turner dec'd formerly Mary Johnson who were heirs and representatives of Isham Johnson dec'd, to appear before the justices of our county court of Goochland in Chancery at the Courthouse on the third Monday in Next March to answer a bill in Chancery exhibitied against them by Benjamin Johnson. And this they shal in nowise omit under the penalty of 100#'s each. And have them there this writ Witness William Miller clerk of our said court at the Courthouse this 25th day of November 1801 in the 25th year of our foundation. Signed: Wm. Miller"
