Walter Pye, per letter of attorney, is acting as the attorney of Charles Pye Esq of PG, to lease land in Mattawoman Neck belonging to sd Chas Pye, for one or two lives. This indenture witnesses that sd Walter Pye, on behalf of sd Chas Pye leases to sd Edward Pye, during the term of the natural life of his daughter, Eliz:a Pye and for the natural life of his son, Walter Pye, a tract of land called Pyes Addition, bounded by his former lot, Potomack River, Charles Tizzick's land, the Town Gutt, sd Edwd's former land, containing 100 acres. The rent is 400 lbs of tobacco the first year on May 1, and 1000 lbs of tobacco each May 1 thereafter, and 2 bushels of wheat each Sep 1, and 1 fat turkey each Christmas, and 6 fat chickens at midsummer starting in 1745. If the rent is more than 30 days behind, Charles Pye may repossess the premises. Edward Pye shall plant an orchard of 2000 apple trees of good winter fruit, within 4 years next, and the same well maintain. The premises are to be left in tenantable condition. Edward Pye shall not cut down or sell any timber or wood on the premises, or cut timber in a wasteful manner, further than to clear the land for planting & sowing or any other use for the plantation. If wood is cut down in a wasteful manner, Charles Pye may cart it away and use it himself. Charles Pye may cut down any white oak timber to saw into plank or heading or pipe hhd or barrel staves, or any black walnut or cherry tree or any crooked ship timber on sd premises, and to convert and carry away the same, leaving enough timber for the use of the sd plantation. Five acres in one corner of the premises shall be left uncut of the timber thereon, which is to be left to grow and improve. The yearly rent is 700 lbs of merchantable tobacco in cask, on each Jan 1. Sd Acherson promises to keep the orchard in repair and to plant 50 apple trees of good fruit, and keep the same in repair. Nor shall sd James embezzle, sell, or give any timber or any ways make use of the same but what shall be necessary for the use of the plantation, and to leave the sd plantation at the end of the lease, in good repair.
