The will of In the name of God Amen. I Luke Heard of Luke Heard St. Mary's County and State of Maryland being at present sickly but of perfect mind and memory & understanding have never the less considering the uncertainty of all _ullinary enjoyments thought it adviseable to make this my last will and testament in manner and form following. Justiprunis I recommend my soul too the mercy of that all gracious being from whence I received, it my body to the ground there to be decently intered at the discretion of my Executrix hereafter to be named, and as to those my worldly goods, which ____ ____ has bestowed upon me, my will and desire is they maybe disposed of in manner and Form following that is to say
Item I give and bequeath unto my friend Eleanor Hopewell who now lives with me during her widowhood only the use of all my stock of cattle horses, sheep and hogs also the use of all my negroes except one fellow hereafter named and all my household furniture, and plantation Utinsils; also during her widowhood _____, I leave her the use of the whole of my dwelling plantation, where I now live except one hundred acres hereafter disposed of, and further my will and desire is that after her death or marriage the whole of what I have bequeathed unto her during her widowhood, shall after decease or marriage go to her son William to him and his heirs forever.
Item I give and bequeath unto my nephew William Heard, son of Mark Heard, one negro man called George to him and his heirs forever.
Item I give and bequeath unto my nephew William Clark, and his wife Mary Clarke, during their natural lives the use of the plantation they now live on Consisting of One hundred acres to be laid off on the back of my land as far as it ___ up to widow Norrisses plantation, so as to mark it contigeous to his new dwelling plantation House and further my will and desire is that after their natural lives, that their son William Hatton Clarke should have and hold the same hundred acres of land with all its ___ ____ to him and his heirs forever.
Item I give & bequeath unto my friend Francis Hopewell one thousand pounds of Crop tobacco o be paid out of my crop or personal Estate.
Item I leave to Elizabeth Greenwell, One Barrel of Indian Corn, I leave to Mary Drury one Barrel of Indian Corn
Also_ lastly do hereby Constitute and appoint my friend Eleanor Hopewell and William Heard of Mark, Executors of this my last will & testament, revoaking and disannulling all former wills by me heretofore made, do ratify and confirm this my last will and testament,
In Testamony whereof I have hereunto set my hand and affixed my seal this seventh Day of April anno que Domini One thousand seven hundred & eighty five. Luke Heard seal signed sealed and delivered in the presence of us the subscibers what his request & in the presence of the testator have hereunto set our hands in Testimony of the same Henry Reeder her Eleanor Clarke mark on the back the back of the foregoing> her was as follows. Susanna Clarke mark Saint Mary's County to wit,
The 10th day of January 1786 then came Eleanor Hopewell and made oath on the Holy evangels of Almighty God that the within Instrument of writing is the true and whole will and testament of Luke Heard late of Saint Marys County deceased that hath come to her hands or possession and that she doth not know of any other. Certified per Jeremiah Jordan Regr of wills for Saint Marys County.
Saint Marys County the 10th Day of January 1786 then came Henry Reeder, Eleanor Clarke and Susanna Clarke the three subscibing witnesses to the within last will and testament of Luke Head late of Saint Marys County deceased and severally made oath on the Holy Evangels of Allmighty God that they did see the testator therin named, sign and seal this will and that they heard him publish pronounce & declare the same to be his last will and Testament that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding, and that they respectively subscribed their names as witnesses to this will in the presence and at the request of the testator, and in the presence of each other.
Certified by Jeremiah Jordan Regr of wills of Saint Marys County. William Heard one of the Executors appointed by this will refuses to act as Executor by virtue of such appointment and doth therefore renounce all his claim right & title to said Executorship accordingly_ Before Jeremiah Jordan Regr of wills of Saint Marys County.
