Before the Chief Judge, Mr. Justice Simpson.) ATTORNEY-GENERAL V WATER SUPPLY AND SEWERAGE BOARD. The suit stands part heard. (Before Mr. Justice Harvey.) KNIGHT V WILLIAMS. In this case the plaintiffs are owners of three conditional purchases in the Wollongong land district, taken up in the years 1845 and 1866. They applied to convert one holding into a mining conditional purchase in the year 1875. In 1880 a proclamation of the catchment area of the metropolitan water supply was publlshed in the Gazette, and the Government maintains that this proclamation extended over the conditional purchases. In November, 1902, the owners applied to oonvert the remaining two conditional purchases into mining purchases, but the followlng February the Crown resumed the land in connection with the Sydney water supply. The plaintiffs maintain that the resumption extended only to the surface, and did not affect their right to obtain a grant for the minerais underlying the surface. They entered into an agreement with Kirton and Eamshaw, Ltd, for the lease of a certain seam of coal under the land, but were unable to give a valid lease until a grant of the coal and minerals had been obtained. They are bringing the present suit in order to have their rights determined, and a declaration made that they are entitled to the rights of minerals underlying the surface. The defence is that the land is within the catchment area, and the plalntlffs are not entltled to the grant. The plaintiffs are John Knight, Thomas Knight, Franklin Knight, Felix Knight, Edwin Knight, David Knight, Harriett Knight, and Mary Jane Knight. James Leslie Williams is nominal defendant on behalf of the Government, the other defendants being Kirton and Earnshaw, Ltd. Mr. R. K. Manning and Mr. Pike, instructed by Messrs. Wilson and Harriott, appeared for the plaintiffs; Mr. Canaway, K.C., and Mr. Hanbury Davies, instructed by Mr. D'Arcy Irvine (Crown Solicitor's Office), for the Go- vernment; and Mr. S. A. The death has occurred of Mr Felix Knight, aged 80, at the home of his son-in-law Mr. Geo King, Kiama. Born at Jamberoo, Mr. Knight was engaged in botanical research, and in 1876 visited New Guinea with Dr Macleay and Mr Macarthur-Onslow obtaining tropical plants and taking the first lemons and limes to that country. He was obliged to return through illness, and soon after Dr Macleay was killed by natives. Mr Knight taught at various schools, his last being in the Camden district. He then returned to Eureka House, Kiama, where he lived for some time. He married Miss Elizabeth Ross and had six daughters. The Rev A H Johnstone officiated at the funeral in the Methodist cemetery Kiama" | |  | |
