}Jean Stewart is a descendant of several Magna Carta surety barons (see [[#Magna Carta Project|text below]]).
== Biography ==There are disagreements in secondary sources about her parentage. All agree that she was daughter of the Earl of Atholl, but disagree about whether it was the first (d. 1507) or second (d. about 1521). Scots PeerageScots Peerage, Sir James Balfour Paul, Editor, Published by David Douglas, Edinburgh, Scotland 1908, founded on Wood's edition of Sir Robert Douglas's Peerage of Scotland Vol 1, p. 440 under Atholl says clearly that it was the second. But the same source under Arbuthnot (Vol. 1, p 288) says that her marriage contract to Arbuthnot was dated 1507, at which date the Earl of Atholl was still the first. Douglas Richardson Douglas Richardson, "Magna Carta Ancestry 1st edition" , Genealogical Publishing Co., Baltimore, 2005. p 780. and "Royal Ancestry", 2013, Vol. 5, p.1 under Spotswood and p. 44 under Stewart says it was the first Earl. Given the direct quote in Scots Peerage under Arbothnott, and concurrence by Richardson, and the fact that the second Earl was born about 1478, which makes him too young to have a marriageable daughter in 1507, we use the first. If this is correct she was surely by the second wife of the first Earl, [[Sinclair-143|Eleanor Sinclair]],. No ''primary'' source is quoted as actually saying this, but Richardson does explicitly say Sinclair.
She, fourth daughter of the Earl of Atholl(Vol. 1, p 288), married James Arbuthnott of Arbuthnott by contract dated Aug. 31, 1507(Vol. 1, p 288), he receiving a tocher of 700 merks.(Vol. 1, p 288).
Brad Verity gave a detailed discussion of the evidence on the medieval genealogy forum in 2014, and he agreed she must be a daughter of the first earl of Atholl.http://archiver.rootsweb.ancestry.com/th/read/GEN-MEDIEVAL/2014-05/1400615297
