Richard Gaines

"Richard Gaines settled in Culpeper County, Virginia. The tax books of Virginia do not date back beyond 1782, but he must have been there previous to that date. His son, William Gaines, a soldier of the Revolution, places his birth in Stafford County in 1761. In the Culpeper County, Virginia tax books it is shown that Richard Gaines owned a farm in that county and lived on it, on which taxes were paid by him from and including 1782, 385 acres besides personal property to 1797; from that year this was reduced to 354 acres to 1801, from that year 1804, inclusive. This was reduced to 104 acres. The attached will show why, by the gifts to this children, these are named in the will.

"I, Richard Gaines, being of perfect memory and sound mind do make this my last will and testament, revoking all others, this 27th day of July in the year of one thousand eight hundred and two in manner and form following. To-wit: 1st, it is my desire that all my just debts be punctually paid. 2nd, I leave unto my living wife, one negro man, called Steven, and one negro woman, called Rachel; two work horses, two feather beds and furniture; also two hundred dollars for the purpose of laying in necessary cattle, household and kitchen furniture, and farming implements during her natural life. 3rd, I leave unto my grandson, Travis Gaines, one hundred dollars for the purpose of his education, which sum I request may be under the direction of my son, Benjamin, but if the said Travis should not live until the sum above mentioned shall be expended for the purpose aforesaid, that the balance shall be equally divided amongst my lawful heirs. 4th, It is my desire that the residue of my estate shall be proportioned amongst my children, having reference to the sums affixed to each of their names, which sums each have received prior to this date, so as for each to have an equal dividend; to-wit: William Gaines L35; Benjamin Gaines L20; Lucy Botts L50.10; Rowland Gaines L21.10; Gemima Speak L25.15; Nathaniel Gaines L24.80; James Gaines L28; Judith Chancellor L38.17; Anne Grigler L29.10; John Cook Gaines L30; Elizabeth Thomas L33. 5th, I consitute and appoint my loving wife, Gemima, Executrix; my sons, William Gaines and Rowland Gaines and Benjamin Gaines, Executors of this will. In addition to the foregoin, I constitute and appoint my friend, John S. Slaughter, and additional executor of this my last will and testament. At a court held for Culpeper County the 18th day of February 1805. This last Will and Testament of Richard Gaines, dead, together with the additional for another executor, was exhibit to court, proved and ordered to be recorded and on the motion of William Gaines, one of the Executors therein named, certificate is granted him for obtaining a probate there of in due form, he having made oath thereto and given bond and security according to law. Teste: John Jameson, Clk. Virginia, County of Culpeper, to-wit: I, C. T. Guinn, Clerk of the Circuit Court in and for the Coutny and State aforesaid, do certify that the foregoing is a true copy of the will of Richard Gaines, which is of record in this office in Will Book E at page 63.
