To the heirs at law of Elijah Prouty, late of Brattleborough in said District deceased, and to all persons interested in the estate of said Deceased, Greetings.
You are hereby cited to appear at the Probate Court, to be holden at the Inn of Col. Paul Chase in said Brattleborough on the first Tuesday of August next, at ten o'clock A.M. to show cause, if any you had, why an instrument, which purports to be the last will and testament of the said Elijah Prouty, deceased, and which exhibited by Hannah Prouty, sole Executrix therein named - should not be proved, approved & allowed by the said Probate Court and you will be heard thereon.

E Prouty's last Will & Testament

Be it Remembered, that, Hannah Prouty, the Executrix named in an Instrument purporting to be the last Will and Testament of Elijah Prouty, late of Brattleborough in said District, deceased, exhibited the said Instrument for Probate, due notice having been given to all concerned by publication three weeks successively in the Brattleborough Messenger as directed by this Court. It is ordered by the Court, that the same be recorded, which said Instrument is in the words and letters following-to wit.

I Elijah Prouty of Brattleborough in the County of Windham, and State of Vermont, being now in the full exercise of my reason, and of sound disposing mind & memory; Thanks be to God therefore; and calling to mind the mortality of my body and that it is appointed unto all men, once to die; do make, ordain, publish and declare, this my last Will & Testament in Manner & form following, that is to say,
Firstly, I order and direct my Executrix hereafter to be named, promptly & speedily to pay all my just debts & funeral expenses. To my beloved wife Hannah Prouty, I give the use, occupancy and improvement of one half of my Real Estate lying & being in Brattleborough, aforesaid during her natural life. And also all my household furniture of whatever kind or description I give to my said beloved wife to be at her own disposal forever.
To my daughter Sarah B. Miller, wife of Lemuel Miller, I give one dollar, that sum with what I have heretofore advanced her, will be her proportion from my estate.
To my daughter Polly A. Miller, wife of Emory Miller, I give one dollar, that sum with what I have heretofore advanced her, will be her proportion of my estate.
To my daughter Lydia C. Prouty, I give the sum of Fifty dollars.
To my daughter Eliza B. Prouty, I give the sum of fifty dollars.
To my son Alfred W. Prouty, I give one dollar, that sum with what I have heretofore advanced him, will be his full proportion from my estate.
To my daughter Hannah D. Prouty, I give the sum of fifty dollars.
To my son Elijah H. Prouty, I give the sum of fifty Dollars.
To my son Lemuel D. Prouty, I give the sum of fifty dollars.
To my son Salmon Prouty, I give the sum of fifty dollars.
To my son Charles S. Prouty, I give the sum of fifty dollars.
To my son Francis D. Prouty, I give the sum of fifty dollars.
All the aforesaid legacies to be paid by my Executrix hereinafter to be named, within two years from and after my decease.
As to the rest residue and remainder of my estate either real or personal of what kind or nature soever, I give & bequeath the same to my beloved wife, Hannah Prouty forever.
And lastly, I do hereby appoint my beloved wife Hannah Prouty, sole Executrix of this my last will & testament, hereby revoking all former wills by me made. In witness whereof, I do hereunto subscribe my name, and affix my seal, this twentieth day of June in the year of our Lord, One thousand Eight Hundred and Thirty Four.

By the honourable John Roberts, Esquire, Judge of the Probate of Wills, etc., within and for the District afoursaid.
To all unto whom these presents shall come, Greetings.
Know ye, that, upon the day of the date hereof, at Brattleborough in the said District, the Instrument, a copy of which is hereunto (displayed?) purporting to be the last Will and Tstament of Elijah Prouty late of Brattleborough in said District, deceased, was presented for Probate before me by Hannah Prouty, therein named Executrix of the same.
And Lemuel Whitney and Eben. F. Putnam, two of the witnesses whose name are thereunto subscribed, being present, made solemn oath that they severally saw the said testator sign and seal and heard him pronounce and declare the said Insturment to be his last Will and Testament, that he was then to the best of their judgment of sound and disposing mind and memory, and that they severally subscribed their names thereunto as witnesses to the execution thereof in the presence of the said Testator and of each other and of the other witness thereto.
I do, therefore, by virture of the power and authority to me given by the laws of this State, approve and allow of the said instrument as the last Will and Testament of the said deceased. And I do hereby comitt the administration thereof, in all matters the same concerning, and of the estate of the said deceased whereof he died seized and possessed, unto her the said Hannah Prouty, the Executrix in the said Will named, well and faithfully to execute the same, and to administer the Estate of the said deceased according thereunto, who has accepted of the said trust and given bonds as the law directs, faithfully to perform the same, and to render an account of her proceedings in the premises when thereunto lawfully required.
In testimony whereof I have hereunto set my hand and the Seal of the said Probate Court at Brattleborough aforesaid the seventh day of August in the year of our Lord one thousand eight hundred and thirty four.

The said Hannah Prouty as Executive and Emory Miller as surety executed a bond to the Probate Court in the sum of Two Thousand Dollars for the legal execution of the trust of the said Executive. An Inventory is to be returned on or before the first Wednesday of October next.
Samuel Clark and Selah Chamberlain of Brattleborough are appointed a Committee to make an Inventory and appraisal of the Estate of the said Elijah Prouty, deceased.
