John Whipple Jr.

( - 15 Dec 1700)

Town Council. 7 Jan 1701. Rebeckah Whipple presented a paper said to be the Last Will & Testament of her deceased husband John Whipple (John Whipple was blind). Witnessed by James Angell, Joseph Whipple, Richard Waterman, James Browne. Angell, Whipple & Waterman were all examined separately and all agreed they had signed the document but it had been folded and they did not know what it contained. Capt. James Browne did not appear before the Council. John whipple, son & heir apparent made objection to the Will. Time granted Rebeckah for consideration.
11 Mar 1701. Capt. John Browne of Swansey appeared before the Council and stated that the paper in question was the same as one he had written at the request of John Whipple but at the time it was signed & sealed it was read in the presence of the witnesses.
8 Apr 1701. Council decided the Will had not been read to John Whipple in the presence of witnesses and may have been under constraints and should be declared invalid. John Hartshorne and William Hoare both testified that John Whipple had perhaps disinherited his only son against his will, since he was helpless and blind and at the mercy of others.

John Whipple died intestate, 15 Dec 1700, and the estate had to be settled by the town council. The decision was to give John Whipple, son and heir, the dwelling and the house lot and the lands and meadows in the Township of Prividence - widow Rebekah was to resign possession. Deliverance Whipple and Dorothy Rhoades were to divide the lands, meadow & commons which John Whipple had bought of Alexander Briant of Milford. Mary Carder and Elnathan Rice received the lands and commons on the west side of the Seven Mile line. John had to pay his "mother in law" 10 pounds. One third of the moveable estate, after paying any debts, was to belong the widow. All remaining part of the Estate to be divided in 5 parts among the children. 22 April 1701.
