Joseph Burgess Haden

(22 Oct 1832 - 22 Oct 1873)

Irene Cook gives place of birth as NC in one place, Macon Co AL in another. He was born in North Carolina.

1850 Census gives his name as Burgess B. and lists his occupation as Teacher. Living in DeSoto Parish, LA. p.187, Hh 378 - with his parents.

I have seen sons of Alexander listed as Joseph B. and as Burgess, both born before 1832 when a Burgess and John are named in the will of George Haden (brother to Alexander). I believe Joseph B. and Burgess to be the same.

Case before the Supreme Court of Alabama, June Term 1862
Haden and Wife v. Tucker. Appeal from Circuit Court of Marengo Co.
Action was brought by Joseph B. Haden and Emma D. his wife, against James W. Tucker to recover damages for the conversion of a slave named Ellen.
The slave was purchased by Mrs. Perkins, mother of Mrs. Haden, in 1839, for her daughter who was then an infant. The purchase money was furnish by Solomon Perkins, paternal grandfather of the child. The vendor's agent made out the bill of sale conveying title to Mrs. Perkins, not the daughter. She accepted it and paid him, and he promised that he would execute another bill of sale. The slave remained in the possession of Mrs. Perkins. In 1840, she married one Woolworth and the slave was seized under execution against Woolworth. Mrs. Woolworth interposed a claim for her daughter. Mrs. Woolworth and her husband soon afterwards moved to Texas, and the slave went into the possession of Solomon Perkins who declared his intention to hold the slave for his granddaughter. Solomon Perkins died in 1845 and in the division of his property in April 1846, the slave was allotted to James W. Tucker, who had married one of his daughters, as a part of his wife's share. The circuit court decided that the Hadens could not recover on these facts and they appealed.
The Supreme Court declared that there was nothing in the record to show the completion of the sale of the slave Ellen to Mrs. Haden. The title was vested in Mrs. Woolworth, then Mrs. Perkins. She accepted title even if she intended a different contract. Only she, or someone claiming in her right, could maintain a suit for breach of that contract. The judgement of the circuit court was affirmed.
