There were a number of lawsuits re his debts, 1792-1802

In May of 1799, the above executors sued Josiah Mitchell for debts owed the estate.

23 Sep 1806. Jane Mitchel, alias Downey & James Downey of Granville are bound unto Maurice Smitts, Sheriff of Granville in the sum of 1000#'s. They are to make personal appearance in the Superior Court of Law to be held at Hillsboro Court House on 6 Oct next to answer Thomas Mitchell, Administrator of David Mitchell, Junr of a plea that she render to him one Negro slave Joe, valued at 500#'s which she detains to his Damage of 500#'s. Petition of Thomas Jeffreys & Milly his wife and William Pannell & Martha his wife vs. Thomas Mitchell, admin of David Mitchell, dec'd. Thomas Mitchell granted Administration on the first Monday of ___ 180_ and took into possession considerably property of David Mitchell. Two years have passed and he has not settled. The defendants and Elijah Mitchell, Charles Mitchell,
John Mitchell, Susan who intermarried with Elijah Moor, Betsy who intermarried with William Saunders, and Hannah who intermarried with James Saunders, are entitled to a Ninth part of said Estate as there distributive share. Thomas Mitchell has settled and satisfied with Elijah, Charles, John, Susan, Betsy & Hannah or their heirs.
