Marshall married Elizabeth Neeley, 27 Feb 1847, but he died before 7 Oct 1848 when his will was introduced. There was a daughter born that year. She married John Morehead and was mentioned in her grandmother, Nancy E. Walters, in her will.

Known all Men by these presents, that we E.D. Neeley and James Neeley are held and firmly bond unto the Commonwealth of Kentucky, in the penalty of Three hundred and fifty dollars which payment well and truly to be made, we bind ourselves, our heirs, & severally, and jointly, firmly by these presents; sealed with our seals and dated this 28 day of July 1851.
The condition of the above obligation is such, that whereas the above bond E.D. Neeley hath this day been appointed by the County Court of Warren County, Guardian to Mary M. Walters infant daughter of A.M. Walters. Note if the said E.D. Neeley shall faithfully discharge the duties of his said office as Guardian, according to law, then the obligation to be void, else to remain in full force and virtue.
