A case came before the U. S. Circuit Court, Southern District of Mississippi, January term 1840. Stephen Cocke for the Commercial Bank of Columbus, plaintiff v. Joseph Halsey, and others, in Error. The case had to do with a deed of trust that had been recorded by a clerk pro tem who was filling in for Robert D. Haden. If the deed was not legally recorded, then the slaves in question had no lien against them. It was finally adjudged that the authority existed for the temporary clerk, therefore the deed was correctly recorded. Within the notes we do find that Robert D. Haden had been duly elected, November 1837, as the clerk of the probate court of Lowndes County, for a term of two years. He took office in February of 1838. He was away conducting business in the state of Tennessee in March of 1839 when William P. Puller was appointed to act in his absence. Haden returned and assumed his duties.

Family data says he moved to Texas 1885....but this does not agree with death date in Texas so it must be a typo. However, the same death date is given for son Richard ...the Bible record has the name as R. D. Haden and it could be either - I doubt they both died the same day. I did find Robert in the 1870 census - in Polk Co, Texas where Richard was living - probably moved there about 1875, rather than 1885. He wasn't there in 1880.
