Stephen Baker's will is in Chilton Co Will Book 1, p.17. Signed 12 Jul 1856; probate 7 Nov 1864. He left property to his wife Charlotte but he remarried to Frances Edwards on 18 Dec 1859, so Charlotte was dead. His son Alfred stated at the probate of the will that Frances Edwards Baker had married James Headley, 20 Aug 1863. The will named the Baker children, but none of Charlotte's Popwell children.

Frances was nee Frances Scott - she was first married to Isaac Edwards who was much older than she.

I Stephen Baker of the
County and State
aforesaid do make
publish and declare this as my last
will and testament hereby revoking all
former and other wills by me made.
First I appoint nominate and appoint
my sons John Baker and Alfred Baker
the Executors of this my will.
Second, I desire all my debts paid
as soon after my death as the condi-
tion of the estate and the interest
of the devises and legacy herein
mentioned will in the Judgm-
ent of my executors warrant and require
Third I give to my daughter Emily
Mims wife of Henry Mims
ten dollars
to be paid to her by my executors
as soon as convenient after my death
which is all she is to have of my estate.
Fourth, I give to my wife Charlotte
Baker
all my property both real
persaonal and mixed for and during
the term of her natural life and
after her deth I give and will
all of said porperty to my four sons
and two daughters, to wit. John Baker
Alfred Baker, Stephen Baker and
Anderson Baker and Sarah Mims
wife of James Mims and Ellender Ald-
ridge wife of Reuben Aldridge (insert: also Charlotte Headly, my granddaughter
)
Note: Charlotte was the daughter of Emily and her first husband James Headley.

equally divided amongst them
share and share alike and if any

of my said (insert: Six) children should die leaving
no children or grand children living
the share or shares of said deceased child
or children I give to the Survivors
of my said Six children then living
to be equally divided amongst them

Know all men by these presents, that I Frances Baker, widow of Stephen Baker deceased of this State and County aforesaid, for and in consideration of the sum of three hundred and fifty dollars to me in hand given by John Baker, the receipt whereof I do hereby Acknowledge, do hereby grant bargain sell and forever quit claim to any and every part of the interest I have in the estate of my deceased husband Stephen Baker consisting of Negroes, land, Horses, and Cattle....

Probate of said county, Alfred Baker the above named
executor who after being duly sworn says that the above account and
final settlement is correct. That the amount above charged in said account
was received by him in Confederate State Treasury Notes that the heirs
at law and Legatees of said decedent are his widow France Baker
and his children (viz) Affiant, John Baker, Stephen Baker, Anderson Baker,
Sarah Headley, wife of Powell Headley, Emily Mims, Elender Aldridge
(insert: all of whom are over 21 years of age)
and Charlotte Headley a grand child of decedent who is under 21 years
