A marriage record from Washington Co, MD may possibly be this couple. Joshua Hicks to Jean Chambers, 18 Jul 1778. She is said to have been the daughter of Benjamin Chambers and Jane Williams. The History of Cumberland and Adams Counties, Pennsylvania, c1886, states that Benjamin was an immigrant from Ireland at age 18 and died 17 Feb 1788, aged 88 years. He lived near where Chambersburg now stands.
However, there is a serious problem with this information. Another History book - from Franklin Co PA, indicates that Benjamin Chambers' daughter Jane married Adam Ross and they continued to live in Pennsylvania. There are more details in her notes.

The following names are found in Chalkey's Chronicles of the Scotch-Irish Settlement in Virginia, Court Records of Augusta County [parent county of Rockbridge] 1745-1800. Joseph Hix/ Hicks, Thomas Hicks, Henry Hicks, Christopher Hicks, John Hicks.
Sept. 1757 Returns of Maj. Andrew Lewis's wanting necessaries. Joshua Hicks listed as a member of the company which was raised during the French and Indian War 1754-1763. Virginia's Colonial Soldiers by Lloyd DeWitt Bockstruck
Note: This service in 1757 would indicate an older man than this Joshua who may have married 1778.

When Nicholas Spring and Elizabeth Hicks married in Augusta Co, 23 Aug 1796, she was listed as the daughter of Joshua Hicks. Joshua Hicks was also security for the bond - could have been her brother - no other record exists of a Joshua Jr. Apparently the family moved to Rockbridge sometime after this marriage and prior to the marriage of Elizabeth's sister Margaret to Robert Lawson in Rockbridge Co in 1800. Rockbridge was formed out of Augusta Co but that took place much earlier - 1778.

2 Aug 1803 John Ricket brought a suit against Joshua Hicks for Trespass Assault & Battery. The cause was dismissed. Court Order Bk 1802-1803, p.380

5 May 1806 Arthur Garten, plaintiff vs. Joshua Hicks, defendant for debt. James Gold came in the court and guaranteed payment. Court Order Bk 1805-1806, p.162

1 Sep 1806 Joshua Hicks vs. John Gailbraith, Petition & Summons. Sheriff had failed to execute a summons and a new one issued. Court Orders, Bk 1805-1807, p.310

3 Mar 1807 Motion by Joshua of Hicks, a witness for James Mackey at the suit of the Commonweath. Mackey is to fifty-three cents, costs, for one day attendance according to law. Court Orders, Bk 1805-1807, p. 436

December Court, 1807. Last will and testament of William Taylor produced in court and proved by two of the witnesses. Ruthy Taylor and John Taylor, the executors were granted probate. Securities Joshua Hicks and Daniel Taylor.

By virtue of an Exchange Treasure warrant #1213, issued 15 Jun 1808, Joshua Hicks was granted two and three/quarter acres by survey dated 21 Apr 1809, lying in the county of Rockbridge on waters of Kerr's Creek, adjoining the lands of Robert McCampbell, his own land, and land belonging to the heirs of John Symons. Begin corner to Robert McCampbell, Hicks's old corner, the corner of Symons's heirs and with Symons's land, Robert McCampbells line to the beginning. Granted 13 Aug 1810. Virginia Grant Book 61, p.153-155

Joshua Hicks appeared in the 1810 Census of Rockbridge Co VA. 2m 10-16; 2m 26-45; 1m 45+, 3 "others" and 1 slave. His was the only Hicks family found. His immediate neighbors were Joseph Goodbar, Saml Miller, Jno Cunningham, Robert & James Lawson, Robt. McCampbell.

13 Apr 1812 Joshua Hicks present for retailing whiskey in the small measure at his house in said county [Rockbridge] without a license to be drank where sold within twelve months last past by information of Edwin Brown who summoned by the jury to give information. Court Order Bk 1809-1821, p.104

14 Sep 1812, By consent of the Commonwealth the suit entered against the Def at last term is discharged. Court Order Bk 1809-1821, p.117
Apparently this was the liquor charge.


Chancery Court Case:
Joshua Hicks v. James McCampbell
1812-011
3 Jun 1812 Joshua Hicks with John McCampbell as his security issued a bond payable to James McCampbell for 42.12.6, to pay the sum of 21.63 twelve months after the date of said note, 12 Sep 1805. A short time after the execution of the bond, McCampbell removed from this commonwealth leaving the bill in the hands of the late John McCampbell, Attorney at Law, for collection. On the 23 Feb 1808, a suit was instituted upon the note aforesaid by James McCampbell on which the said John McCampbell was his attorney. Before the initiation of the suit, Hicks paid in part discharge, $40 to John McCampbell. Shortly after the initiation of the suit Hicks paid an additional sum of $30 and shortly after that an additional $10 and 300 #'s of pork at $5 per hundred. These sums were paid in discharge of the debt. No other account existed between the said John McCampbell and Hicks to which the money could have applied. Relying on his integrity, Hicks had failed to get receipts for his late payments. He went to the home of McCampbell and got him to acknowledge before a witness that the debt had been entirely discharged; he promised to get to the clerk's office to give the credits. He became unable to attend any business and died without giving the credits. Hicks property is liable to be taken even though he has paid every cent thereof. He desires relief and wishes the following be made defendants: James McCampbell and Mary McCampbell, administratix, and McDowell Reed, administrator, with the will of John McCampbell dec'd.

3 Jun 1812 Injuction granted Joshua Hicks to stay proceedings on a judgment recovered against him in this Court by James McCampbell on his entering Bond for $25.

A summons executed on S. McD. Reid shows him to not be an inhabitant.
Stephen McFarland was Joshua's security on his $25 bond to obtain the Injunction.

17 Mar 1813, Joshua Hicks and wife Jean, sold 264 acres to John Miller for $4000. There was an adjoining tract of 2 3/4 acres. They joined the lands of Robert McCampbell and John Simond's heirs. DB H, p.292

In 1820, Joshua Hicks was in Jackson TN as was his son-in-law, Robert Lawson. Robert had 1m under 10, 1m 16-18, 1m 16-26 [maybe the same young man] and two males over age 45; 1 female under 10, 2 females 10-16 and 1 female over age 45. Since Robert had an extra older male some researchers have thought him to be his father Robert, others have thought it to be Joshua Hicks. There is no way to know - could have been a farmhand unrelated to the family....

18 Sep 1828. Land grant #837 for 50 acres on Blackburn's Fork of the Roaring River, Jackson Co, TN. This was the same area where Robert Lawson received a grant. Again, there is no way to be certain, but I suspect this could be Joshua the younger, not his father.

By 1830 & 1840 in Jackson Co, I believe the following information would apply to the younger Joshua who is thought to have been born circa 1779:
1830: Joshua Hicks: 1m 5-10, 1m 10-15, 1m 50-60; 1f 10-15, 1f 30-40, 1f 40-50.
1840: Joshua Hicks: 1m 15-20, 1m 60-70; 1f 50-60.
