James McKimmey

The name appears to be McKimmey in the Wayne Co Will Book copy of Jonathan Adamson's will, but I doubt that was correct. It is McKinney in the transcribed marriage records. However in the digital images of the Marriages Licenses for Wayne Co on FamilySearch.org, the name is plainly James McKimmey to Susannah Adamson - license issued 11 Sep 1822; married by Samuel Taylor, Elder, on 15 Sep 1823. And the children use the spelling McKimmey.

James McKinney, 1m 26-45. 1f under age 10. 1f age 16-26.

2 Oct 1834. James McKimmey of Henry Co IN received a Land Patent. The East half of the SE quarter, Section 1, Twp 19 North, Range 9 East. 80 acres. Land Office at Indianapolis - land now falls in Delaware County

If this is the same James - then who are all the 12 children? and it would seem a spouse was counted. There is no date on the census record. You would expect that some of the males would be found in Delaware Co in 1850 - yet the only other McKimmey than James was Jesse McKimmey, b. 1804 in NC and possibly a brother to James.

There is a James McKimmey in the 1850 census in Delaware Co, IN. Since Susannah had died in 1840, one would expect him to marry again. If this is the same James in 1850, he would appear that he had just married someone with children from two former husbands - I have found no marriage record for a second marriage. Hh 251

My Note: after studying census records, James McKimmey's will, etc - I believe this is the truth of this record. Ruth had married James McClain in 1848 and he was probably already dead, Joel's name just assumed to be the same as hers. Joseph Gallion, b. in Illinois was the child of Nancy's first marriage. The others marked as Gallions were actually all McKimmey children - James & Jesse sons of Susanna Adamson, the others were children of Nancy & James McKimmey.

The digital image of a Will has been posted on an Ancestry family tree. p.203 can be read, but the source is otherwise unidentified. The names of some of the children are similar to those listed in 1850, many very typical of Adamson given names, and the numbers could somewhat explain the children in 1840.
James McKimmey's Will
Be it remembered that on this 17th day of June AD 1876, the following Will was filed and presented for Probate and entered of Record in these word, to wit:
In the name of the Benevolent Father of All, I, James McKimmey of Muncie, Indiana, do hereby make and publish this as my last Will and Testament as follows, to wit:
Item 1. I will and direct that at my death all my just debts and funeral expenses be first paid.
Item 2. I give, devise and bequeath to my wife Nancy McKimmey, all my household goods and furniture and $1000.00 in Cash in lieu of her interest in my Estate that the Statutes of this State would give her. And I desire my Executors to loan out that money at ten percent interest and to pay her the interest and as much of the principal as she may need to render her comfortable.
Item 3. I have advanced to my daughter Nancy Ann McLain $275 more than to my other children counting a note for that amount which I hold on her and which I wish given up to her, and I give desire and bequeath $275 in cash to each of my other children, to wit: Joel R. McKinney, Lavina B. McKimmey [believed copied wrong - this is son Levin Bishop McKimmey], James N., McKimmey, Jesse W. McKimmey, Araminta Shaw, Margaret Modlin, Hannah Barda [Baxla], Ruth Heath, Susan Thornburgh and Rachael West, and after the payment of all the foregoing items, I give, devise and bequeath all the residue of my estate both Real and personal to all my said eleven children equally, share and share alike.
Item 4. I hereby nominate appoint as Exectors of this my Last Will and Testament my sons Joel R. McKimmey and Jesse W. McKimmey.
In testimony whereof I have hereunto set my hand and Seal this 19th day of June 1875
