Case from the Supreme Court of North Carolina
Q. T. PURSELL v. JOHN D. LONG. December Term, 1859.
THIS was an action on the CASE for a deceit and false warranty in the sale of tobacco, tried before DICK, J., at the last Fall Term of Rockingham Superior Court.
The plaintiff declared in two counts: first, a deceit, and secondly, for a false warranty in the sale of one hundred boxes of manufactured tobacco. The tobacco was delivered in August, 1857, and to prove that it was rotten, in the fall and winter of that year, plaintiff proposed to read the deposition of one W. J. Totten, of Georgia. The notice was to take the depositions of L. T. Watkins, N. Cobb and others, in the office of W. T. Holderness, No. 132 Broad street, Columbus, Georgia, by W. T. Holderness, a commissioner and notary public, on the 15th day of March, 1859. The deposition was taken, as declared in the caption, by William T. Holderness, commissioner and notary public, on the 15th day of March, 1859, at his office No. 128, Broad street, Columbus, Georgia. The defendant objected to the reading of this deposition, as he did not appear, and no one for him, at the taking thereof. The Court admitted the deposition to be read.
There was no more mention of W. T. Holderness, but the outcome of the case in Rockingham was: Verdict for plaintiff. Appeal by defendant. The judgment was affirmed by the Supreme Court.

William T. Holderness seeks appointment as guardian of the minor children of Julia Fisher. These children, Frances Clark, David Clark, and George W. Fisher are entitled to an undivided half of an estate that includes eight slaves. In 1861, these eight slaves were Alfred, age 7, Billy age 5, Dick approximately age 35, Grigg age 12, Homer age 8, Job age 3, Maria age 45, and Squire age 35.
[I have no idea about any relationship to Julia who must have been married twice - to a Clark and then a Fisher. Neither William, nor his wife had a sister named Julia.]

He was not in the Directories earlier or later, so must have lived in Atlanta just a short while.

Obituary of William T. Holderness in "The Atlanta Constitution", January 1893, states that he died of heart disease. Lists an only son, Col. Sidney Holderness as a leading lawyer of Carrollton. Burial at Whitesburg.
Evidence has been found that son William was living in Chattanooga, TN for the 1900 census and was still there at the time of his mother's death in 1909. In fact, his mother must have been visiting him in Chattanooga when she died. I found the eldest son, Scott, living in California in 1900.

William T. Has a military marker, Carrollton City Cemetery and is buried as Col. Wm. T. Holderness. His rank given as Quarter Master, 7th Confederate Cavalry, CSA.
