Michael Roby of CC lodged with the Clerk of the Court here the following note & warrant for attachment -
I promise to pay Mickeell Hines 500 lbs of tobacco "four Valey Recd" [for value received]. Signed Sep 14, 1734 - Daniel (- his mark) Rose.
Apr 17, 1736. Then Michael Roby made oath that there is due to him of the within 250 lbs of tobacco. Sworn before - Gustavus Brown.
Whereas it is made appear to me by Mich:l Roby that Danl Ross has absconded with a design to defraud his creditors, and that he owes sd Mich:1, by note, 250 lbs of tobacco, and prays my warrant that atta. may issue, these are to require you to issue attachment for the afd sum &c. Signed Apr 17, 1736 - Gust: Brown. To Mr. Sand Hanson, Clerk.
Whereupon it was commanded the Sher: that of the goods, chattels, and credits of the sd Daniel Ross in his bailiwick being, he should attach 250 lbs of tobacco, damages, and 400 lbs of tobacco for costs, and bring the attached suns to next Jun Court, then and there to be condemned for the use of sd Mich:l unless sd Daniel comes to Court and answers unto sd Mich:l of a plea of trespass upon the case, and that by good and lawful men of his bailiwick, he should make known to the garnishees to be in sd Jun Court, to show cause, if any they have, why the attached sums, should not be condemned, and the sd Mich:l have thereof execution. And now, comes Mich:l in his proper person and offers himself against the sd Danl: of the plea afd. The Sher: returns the writ as follows: I certify that on Apr 17, 1736, I attached sundry goods and chattels of sd Daniel Ross in the hands of Eliza: McHorne, amounting to 550 lbs of tobacco, and I have made known to sd garnishee that she is to be at sd Jun Court to show cause why the effects afd so attached should not be condemned, before Thomas Sympson & Mich:l Boswell, 2 good and lawful men of my bailiwick. So answers Geo: Dent, Sher:.
We, being appointed to appraise and value 1 small gray horse and 1 old gun as the effects of Daniel Ross, attached by sd Sher: in the hands of Eliza: McHonce, at 550 lbs of tobacco, total. Signed Apr 17, 1736 - William Greene, James (M his mark) Magatie, Thomas (8 his mark) Simpson, Michael (M his mark) Boswell.
Whereupon the afd Mich:l into Court here in his proper person comes and prays condemnation of the goods and chattels so as afd attached. The afd Eliza:, though called, came not. Ordered that the sd Mich:l have condemnation, as afd, and execution.

Charles County Court Records, November 1741 Court, Liber T#2, Page 301-302It was commanded that the Sher: should take Richard Roby, late of CC, planter, and him safe keep so that he should have his body before next Nov CC Court, to satisfy unto Jonathan Davies Jr, 2254 lbs of tobacco, a debt which to the sd Jonathan lately in sd Court recovered against him, and 283 lbs of tobacco for his damages which he had by occasion of detaining that debt. And now here, the Sher: returns to the Court here the writ afd thus endorsed, viz, The Plaintiff releases the penalty on the Defendants paying the prin: interest and damages; and these words following, viz, Cepi Corpus, Richard Tarvin, Sher. And with the writ afd he returns to this Court the following supersedeas:
You, Richard Roby of CC, planter, Thomas Roby and Michael Hinds Roby of CC, planters, do confess judgment to Jonathan Davies Jr, for 2254 lbs of tobacco, a debt, and 283 lbs of tobacco, damages, which was recovered by sd Jonathan Davies Jr against the sd Richard Roby on Aug 11 in CC, the sd sums to be levied of your bodies, goods, or chattels, lands or tenements, for the use of the sd Jonathan Davies in case the sd Richard Roby does not pay to sd Jonathan Davies, the sd sums of 2254 lbs of tobacco debt as afd, and 283 lbs of tobacco damages so as afd recovered against him, with additional costs thereon on next Feb 10.
The above supersedeas taken and ack. before us, two CC Justices, on Aug 3, 1741. Signed - Robert Hanson, S Hanson.

To son Thomas Robey, land on the north side of branch called Thompsons Branch, being pt of two tracts called "Hinds Fancy." 60 A., and "Hinds Inspection," 120 A. and If he dies without heirs then to son Hines Roby.
To son John Taylor Roby, pt of tract an south aide of above Thompsons Branch which I now live upon, and If he dies without heirs then to son Peter Roby.
To son and daus Peter Roby, Hines Roby, Mary Roby, Anne Roby, and Liddia Roby, other 2/3 of my personal estate.
