=== Immigration ===: Sometime before 1637 he went to Virginia, by which time he had established himself on Mulberry Island, just down the James River. He was an officer in the British Army of Occupation. In 1642/3 he became a Burgess for James City but moved to Warwick County where in 1647 he became Justice of Warwick. In 1653 he returned to England but went back to Virginia aboard the ''John Ambrose.'' His nephew Samuel Filmer joined him in Virginia in 1654. He seems to have visited England again in 1662. He died after 1673, leaving at least one daughter Martha by his wife Elizabeth. According to Bruce John Filmer's book, 'The Filmer Family of Kent- Part One', he left a will dated 1672. Under it he left a legacy to provide plate for the Mulberry Island parish church.

: Richardson does not give a maiden name for the Elizabeth who married Henry, son of Edward and Elizabeth. Nor does he give a date of marriage or a birth date for either Henry or his wife. The parish register for Horsmonden shows birth, marriage, and burial records for an Elizabeth Austen, which show that the Elizabeth born to Jeffery Austen in 1622/3 died young (buried 1629) and could not be the Elizabeth Austin who married a Henry Filmer in 1641. Henry's wife Elizabeth, by her testimony about 1650, was born about 1601. To [[Noland-165|me]], this also casts doubt on a 1641 marriage as well as the immigration date of 1652 for Henry's family (while it appears he did sail from England to Virginia in 1652/3, reports of who accompanied him vary).
