== Biography ==
Sir David was probably born about 1265. The first he appears on record is about 1290/95 and he is of age, thus over 24. He was the only son to Sir Michael Wemyss, Lord of Wemyss and his wife, whose name is unknown but believed to have been the coheiress of Sir David Lochore as the Wemyss family inherits these lands.
He died about 1330 but certainly before 1332 as it is his son that represents the family at the coronation of Edward Baliol at Scone in September 1332.

== His Life ==Nothing is known of him until 1290/95. Balfour Paul notes[[#S-1]]Balfour Paul; Vol 8, Page 478 that during this time he granted certain lands in the Barony of Lochore (about half his title) to Annabella Sinclair, the widow of Sir Robert Bisset. There is no record of any marriage between them although clearly there was a relationship. This transaction is noted on the People of Medieval Scotland dataset. [[#S-4]]PoMS; http://db.poms.ac.uk/record/factoid/75130/ In this transaction Annabella is named as " Lady Annabelle, daughter of Sir William Sinclair, knight, wife of the late Sir Robert Bisset, knight".
For him to have performed this grant, without his father as witness, indicates that he had, in his own right, title and had inherited them from his mother. He calls himself "son and heir" and his father didn't die until 1320 so he had not yet inherited his paternal title.
While there is nothing in this record that would suggest a marriage the lands that were granted were his mother's hereditary lands. However the grant also indicates that the grant was for her to hold for her lifetime. Note Balfour Paul suggests that "he granted the charter of the Lochore lands, to her and his children by her" whereas my interpretation of the Charter, available by reference above, is that it was simply to her for her lifetime. The Lochore lands remain in the Wemyss family and there are later Charters on these lands in 1372[[#S-1]]Balfour Paul; Vol 8, Page 481 suggesting she died and the lands returned and the grant a repayment of an obligation to or sacrifice by Sir Robert Bisset .

== Marriage ==He is known to have married a Marjory Ramsay, daughter to Walter Ramsay, at some timebefore 1304.[[#S-1]]Balfour Paul; Vol 8, Page 479 His eldest son, Michael, was already a Knight in 1316 as he appears as a witness, along with his father and grandfather, to a charter of Christian Hay. He must therefore have been born in 1290/92 and thus the marriage must have occurred at this time.

== In Service of Scotland ==Balfour Paul quotes[[#S-1]]Balfour Paul; Vol 8, Page 479 Wynton when he states that Sir David Wemyss was one of the ambassadors sent to Norway, in 1290, to bring back the Maid of Norway to be Queen of Scotland.
There are two Wemyss appearing in the Roll of 1296; Michael de Wemys (holding the title), the father, and David, listed to be of the District of Fife. David gives homage at Berwick on 28 Aug 1296.[[#S-10]]Bain's; ii, Page 209
There is a record[[#S-10]]Bain's; ii, Page 232, no 884 of a letter from Edward I to him, amongst others, to meet with Hugh de Cressingham treasurer of Scotland, and Osbert de Spaldington who was an assistant to Cressingham. The records is dated 24 May 1297.
Not long after he must have joined [http://en.wikipedia.org/wiki/William_Wallace Wallace] for he and his wife, stated to be Marjery, are declared "rebels" and lands, including her dower lands near Berwick are forfeit.
In this account,[[#S-10]]Bain's; ii, Page 400, no 1538 dated 11 Apr 1304 from Kinghorn (which I presume is the Royal burgh town in Fife, Edward I commands that "as Sir David de Wemes and Margery his wife, Scottish rebels, have come to his peace and done fealty" Margery's dower lands outside of Berwick town are to be delivered to them. This was at a time when a number of Scottish nobles were suffering under the continual presence of Edward in Scotland and the ongoing [http://en.wikipedia.org/wiki/Sieges_of_Stirling_Castle Siege of Stirling].
He is one of a number of nobles acting as a juror on an inquisition[[#S-10]]Bain's; ii, Page 413, no 1592, at Perth on 17 September 1304, into the destruction of the lands and castle at Methven.

== Death and Legacy ==Balfour Paul suggests[[#S-1]]Balfour Paul; Vol 8, Page 479 that at some point around 1307 he joins Bruce but I can find little that suggests he was active after 1307. The records concludes that he died about 1330, certainly before 1332.
He leaves two sons; Sir Michael who, already a knight before 1316, must have been born around 1290; and John.
