Sir WALTER HALYBURTON of Dirle∣ton, who succeeded also to his cousin sir John of that ilk, as before observed.
He was one of the hostages for king James I.'s ransom,*anno 1424; but obtained liberty to return to Scotland, anno 1425.
He was appointed one of the ambassadors extraordinary to the court of England,* and one of the wardens of the marches, in 1430.
He was constituted lord high treasurer of Scotland in the minority of king James II. from whom he got a charter,*dilecto consan∣guineo et the saurario suo, &c. anno 1439.
He was created a peer in the year 1440 or 1441,* and as such sat in parliament.
He married lady Isabel Stewart, daughter of Robert duke of Albany, and got a charter under the great seal from the said Robert,* then governor of Scotland, wherein he is de∣signed his beloved son, to which Alexander, George, Fergus, and John Halyburtons are witnesses, anno 1407.

"Walter de Halyburton" was one of the numerous Scottish Commissioners who agreed to a truce and payment of the King's ransom in the City of London in June 1369. Halyburton's seal was attached.''Calendar of Documents relating to Scotland'' edited by Joseph Bain, FSA Scot., etc., vol.iv 1357-1509, HMSO, Edinburgh, 1888, no.154, p.35-6.
He '''married''' Lady Isabel, daughter of Robert Stewart, Duke of Albany, and got a charter under the Great Seal from the said Robert, then governor of Scotland, wherein he is designed his beloved son, to which Alexander, George, Fergus, and John Halyburtons are witnesses, anno 1407.
In 1409 Walter Halyburton, Lord [of] Dirletoun was instrumental in the Douglases, the Duke of Albany and the Dunbar Earl of March reaching a conciliation.''Genealogical memoirs of the Family of Sir Walter Scott, Bt.'', with a reprint of the ''memorials of the Haliburtons'' by the Rev. He was knighted on 21st May 1423.''The Complete Peerage'' by G. E. Cockayne, edited by the Hon. Vicary Gibbs & H. Arthur Doubleday, vol.iv, London, 1916, p.383.
Amongst a great many other Scottish nobles, including his neighbour Sir Robert de Lawedre of the Bass, Knt., Walter de Halyburtoun, Lord of Dirletoun, was one of the hostages for king James I.'s ransom in the Safe-Conduct dated 3rd February 1423/4. In a subsequent Indenture dated March 28th there is a list of those contributing funds for King James 1st's ransom including Walter, Lord of Dirletoun, 800 marks. On July 4th he was still have been in captivity as he is one of those listed in a Crown Memoranda for safe-conducts to be issued for his servants. He was captive, with others, in Knaresborough Castle, Yorkshire, when a Warrant was issued on 28th February 1424/5 for them to be taken to Durham and exchanged for others approved by the Wardens of the Marches. His liberation can be found in a Letter from the King to the Bishop of Winchester, Chancellor, dated 16th July 1424. Bain, 1888, nos. 942, 952, 963, 973, 983. pps: 190-1, 193, 196, 199, 201. Nowhere here is he referred to as Lord Haliburton and only as (feudal) Lord of Direltoun.
On 24th January 1429/30 a Warrant of Safe-Conduct was issued for the Scottish Commissioners with 800 men to meet the English at Hawdenstauk ro redress complaints. One of those Commissioners was "Walter de Halyburton, Lord of Dirletoun".Bain, 1888, no.1032, p.212-3. Cockayne suggests that he was one of the Wardens of the Marches in 1430 but this is doubtless an error for being one of the commissioners herein.Cockayne, 1916, p.383.
However, in the first Parliament of King James 1st following his return to Scotland in 1425 he ordered the arrest of Murdoch, Duke of Albany with 27 others, one of whom was Walter Haliburton of Dirletoun.Rogers, 1877, p.16.
Later, on 5th July 1438, Walter Haliburton is called one of the King's counsellors when he was made Lord High Treasurer of Scotland.Rogers, 1877, p.16.Cockayne, 1916, p.383. In the charter of appointment Walter is termed ''dilecto consanguineo et the saurario suo'', &c., where the King is calling him his beloved cousin.
As feudal baron of Direltoun he had the right to sit in Parliament.
He died shortly before 10th May 1447.Cockayne, 1916, p.383.
===Lord of Parliament?==="He is said by some to have been created, about 1441, Lord Dirletoun, or Lord Halyburton of Dirletoun, making him the first of this grouping. However ''The Scots' Peerage'' [by Sir James Balfour-Paul, Lord Lyon King of Arms] can fin no evidence of his creation, and thinks that his son John was so created. In 1439 he is called "a noble lord Sir Walter, Lord of Dirletoun"; on 2nd April 1444 he is called "Sir Walter, Dominus de Haliburton, knight." In charters he is never called "Dominus Haliburton", and only once "Dominus de Haliburton" [the 'de' is important here because this means Lord of Haliburton, as in Lord of that Ilk]. On 17th October 1449 he is referred to in a charter as "the late Sir Walter de Haliburton, father of John."Cockayne, 1916, p.383-4 and footnotes.
