Mary PRATER

(1823 - )

Many genealogies show her as marrying a Samuel Pendleton, but Bob Prather of Tulsa points out a problem with this:

Prater researchers have Mary Thomas, first wife of Samuel Pendleton, as Mary Prater. In the Warren County Courts August Term 1871, a settlement was made in the court that Benjamin P. Prater was judged to pay the "legates or distributees" of the Thomas M. Prater estate the sum of $1.00 each. Samuel Pendleton and his wife Mary were in the list of legates or distributees along with Thomas M. Prater's siblings. This court paper has been cited by Prater researchers as Mary being a sister of Thomas M. Prater (daughter of Archelus Prater) and the Archelus Prater 1830 census records does show a female listed being born 1820-1825. The court papers read (in part): Warren County Court Clerk Minute Book Vol 3 date Aug, 1867 - Dec., 1873 August Term Warren County Court 1871. B. P. Prator administrator of Thos. M. Prater decd. In this cause it appearing to the court at this the August session of said court 1871. That the Administrator by his agent Warren Cummings; has made a final settlement with the clerk of the Warren County Court; which settlement shows the liabilities of said Administrator to be Fourteen (14$) Dollars; and it appearing to the court that said Administrator B. P. Prator is now a nonresident of the State of Tennessee and a citizen of the State of Missouri, it is therefore ordered by the court that said Administrator B. P. Prator or his agent Warren Cummings pay over the balance of the money so found in the hands of said Administrator to the clerk of this court and take his receipt for same, and the clerk shall distribute the same among the legates or distributees entitled to the same ... Samuel Pendleton & wife Mary, citizens of Cannon County ... Amt due Saml Pendleton & wife Mary $1.00 ... I've been told by Pendleton researchers that Mary was Mary Thomas. Samuel Pendleton researchers say she was a Thomas. I went back to Cannon County and looked at the original marriage book for her entry. Sure enough her name was Miss Mary Thomas and she was married by Martin L. Prater Justice of the Peace for Cannon County. Here's the entry in the marriage book: Cannon County Marriage Book 1 Entry 336 Pg 57} Samuel Pendleton to Miss Mary Thomas. "I solemnized between the parties named in the within License on the 21st day of December 1842. By me, Martin L. Prater Justice of the Peace."
