John K. Garner, the subject of this memoir, was born in South Carolina, in February, 1782, and died, of typhoid feaver, December 6, 1851, aged sixty-eight years and some months. He came from his native State when a young man to Madison County, Ala., when he married Miss Ruthe Russell, daughter of Rev. William Russell, deceased, and afterwards settled in Jackson county, same State, where he remained until removed by death from this to the spirit world. As respects the chacter of brother Garner, it was that of a Christian gentleman; as neighbor, there was none better; as a husband, he was kind and affectionate; as a father, doating and indulgent; and in his death this community has suffered a great calamity. The church has lost one of its brightest ornaments, and there is a vacuum made that will never be filled again. Brother Garner died as he lived. He was happy for two weeks before his death, and spoke of it with calmness and exultation. He even craved to meet the monster, that he might conquer him. He has passed over the flood, leaving a wife and four children to join those who are gone before. May kind Heaven sanctify this deep affliction to the good of the bereaved and us all, and may we imitate his godly walk, and prepare to meet him where death never comes. J. C. Taylor

Application to Sell land for division
To Milton Brown Judge of the Probate Court for the Couty of Jackson State of Alabama
The application of Edward E. Douglas states that John K. Garner made and published his last will and testament & departed this life-- At his death he was a resident citizen of Jackson County. After his death said will & teastament was by a decree of the Probate Court of said County set up and established as his true last will and testament. After the said probate the persons appointed by said will as the Executors thereof declined to act and thereupon said Probate Court granted letters of Administration with the will annexed on said Garner estate to this applicant and thereupon he qualified & took on the burden of said office.
At his death said Garner was mmmmmm and possession of certain tracts of land lying in said County anddescribed as follows to each _ The South west 1/4 of Sect 4 Township 5 Range 3 East. The East half of the South west quarter of Sect 4 Township 5 Range 3 East The East half of South west quarter of Seceighteen Township five Range four East and also a tract of land lying in the County of Marshall and described as follows The North west quarter of the North east quarter of Section 19 Township 5 Range 4 East.
By said will the tesator gave the East half of said South west quarter of Section 4 Township 5 Range 8 East to his two sons John & William and directed that all the ballance of his lands be divided amongst his four daughters Elizabeth, Sally, Jane & Mary _ Testors daughters married & died and the following persons are his only heirs at law. James E. Taylor Jno W. Taylor Flemming J. Taylor Rutha Ann Taylor Olevia Taylor. Testers daughter Jane married Jno M. Grimble & is now his wife and resides in Texas, Testors daughter Mary married Ashworth, he is dead and she is now a widow _ Testors daughter Sally married and is dead and the following persons are her heirs at law Jno Wingo and Robert Wingo _ Testors son John died and Laura Garner is his only heir at law, and the persons above desendents and William T. Garner are the only heirs at law & sole legaties of said teastor
Said Laura Garner is an infant under the age of twenty one and resides in said county of Jackson, Ala. _ the others are over the age of twenty one years _ Robert Wingo resides out of the State of Alabama. William Wingo resides in the County of Franklin in said State of Alabama _ the others reside in the County of Madison in said State. Said lands cannot be equally divided amongst said heirs at law & devises
Whereupon he prays this court to order the sale of all of said lands except that given to Jno and William Garner for the purpose of distribution and to that end, that citations issue & publications be made.

Report of sale of land
To the Hon Milton P. Brown Judge of the Probate Court of Jackson County State of Alabama
Edward E. Douglas administrator of the estate of John K. Garner late of said county, respectfully reports that on the first day of March A. D. 1867, by virtue of an order of this court heretofore made he proceeded to sell to the highest bidder, at the late residence of said deceased, in said county, the following described tracts or parcels of land, lying and being in said County of Jackson, and in Marshall County in said State, as the property of the estate of said decedent John K. Garner, to wit: The West half of the South west quarter and the East half of the North west quarter of Sec. four, in Township five, Range three East, containing one hundred and sixty acres, lying in said County of Jackson, and the East half of the South West quarter of Section eighteen, Township five, Range four East, containing eighty acres, lying in said County of Jackson and the North West quarter of the North East quarter of Section nineteen, Township five, Range four East, containing fourty acres lying in said County of Marshall. Due notice of the time and place of said sale was given, as the law requires, and at said sale John W. Douglas being the best and highest bidder became the purchaser of the West half of the South west quarter of Section four in Township five Range three East, containing eighty acres, at and for the sum of nine hundred and fourty dollars, one third paid in cash, the balance in one and two years. He also became the purchaser of the East half of the North west quarter of Section four, Township five, Range three East, containing eighty acres, for the sum of one thousand and sixty dollars, one third cash, the balance in one and two years, for which balance the said John W. Douglas executed his two bonds, with Wade N. Douglas and John T. Garner as his securities each for the sum of six hundred and eighty dollars, payable one & two years after date of said administration.
At said sale C. J. Lewis being the last and highest bidder became the purcher of the East half of the South west quarter of Section eighteen, of Township five, Range four East, containing eighty acres at and for the sum of three hundred and eighty dollars, one third cash, the balance in one and two years, for which balance the said C. J. Lewis executed his two bonds, with Henry Lewis and J. A. Kennamore as securities, for the sum of one hundred and twenty two dollars and fifty cents each payable in one and two years to said administration. And at said sale John P. Smith, being the last and highest bidder, became the purchaser of the North west quarter of the North east quarter of Section nineteen, Township five, Range four East, containing fourty acres, at and for the sum of two hundred dollars, one third in cash, the balance in one and two years, for which balance the said John P. Smith executed his two bonds, with William B. Terry and P. B. Publes as his securities for the sum of seventy three dollars and thirty three cents each payable in one and two years after date to said administratior.
Therefore said Edward E. Douglas Admn asks his Honorable Court to confirm said sale. All of which is respectfully Submitted.

Garner deceased, that said sale was legally and fairly made, and conducted and concluded and that the lands therein mentioned sold for a sum not greatly less or disproportionate to their real value.

To the Hon. Milton P. Brown Judge of the Probate Court of Jackson County State of Alabama
Edward E. Douglas Administrator of the estate of John K. Garner late of said County of Jackson, respectfully reports to your Honor that the sale of the lands belonging to the extate of said decedent was by said Administrator heretofore reported to the Court and having been confirmed by your Honor he now reports that Charles J. Lewis who was the purchaser of the East half of the South west quarter of Section eighteen, Township five Range four East; containing eighty acres more or less, lying in said County at and for the sum of three hundred and eighty dollars, as will fully appear by the report heretofore made of said sale to which referencee is made - has paid to said administrator the whole of the purchase money now therefore said Edward E. Douglas Administrator as aforesaid, applies to your Honor for an order that a conveyance shall be made to said Charles J. Lewis of said County by said administrator, or such other person as his Honorable Court may appoint conveying all right title and interest which the deceased had in such lands at the time of his death. All of which is respectfully submitted.

Your petitioner respectfully represents unto your Honor, that she is a minor over the age of fourteen years and a resident of this County, that she has an estate in her own right and is advised that it is necessary that she should have a gurdian appointed by your Honor, and it is proper she should choose said guardian. Your petitioner therefore begs leave to nominate to your Honor for her guardian Hugh L. Parks of this County, and to ask that he may be duly appointed.
