"In the Cleveland Probate Court, May Term 1916 - In the Matter of the Estate of H. S. Thompson, deceased - Order Rejecting Will, June 2, 1916. On this day is presented to the Court the document purporting to be the last Will and Testament of H. S. Thompson, deceased, and this cause comes on to be heard upon said document and the probation thereof before the Clerk; the petition of M. D. Thompson, J. S. Thompson, and J. H. Thompson to reject the same, the answer or response of Mrs. S. A. Thompson, and the testimony of witnesses, taken before the Court. And after hearing the testimony and argument of counsel, the Court find that at the time said Will was executed, the said H. S. Thompson was not of sufficiently sound and disposing mind to qualify him to make a Will. It is therefore considered, ordered, and adjudged that said Will be and the same is hereby rejected, set aside and held for naught. To which ruling and judgment of the Court the respondent excepted and prayed an appeal to the Circuit of Cleveland County. And now comes S. A. Thompson, the respondent, and files with the Clerk in open Court, her affidavit and prayer for appeal from the order and judgment rendered herein, rejecting said Will, and it appearing that said respondent has complied with law, in her affidavit for appeal, it is ordered that said appeal be granted."
