John T. Terry

"Will of John T. Terry. State of Georgia. County of Troup. In the name of God amen. I, John Terry of the above state and county, being of sound an disposing mind, deem it right and proper as regards both myself and family, to make a disposition of the property with which a kind providence has blessed me, to therefore make this my last will and testament, hereby revoking all others heretofore made by me. Item 1. I desire and direct that my body be buried in a manner suitable to my circumstances and condition in life, my soul I trust shall return to God who gave it. Item 2. I desire and direct that my just debts be paid by my executor without delay, as there is no necessity for such delay. Item 3. I desire and direct, i give and bequeath to my beloved wife, Julia Terry all my property, both real and personal to be kept together and managed to the best advantage, and hereby direct that she as my children become of age or marry give to them such amount of property as she may think proper, being about equal to that, heretofore given to those of age the sole right to remain in and belong to them and their heirs. Item 4. At the death or marriage of my wife all the property remaining on hand is to be sold and divided equally among all my children for the use of them and their heirs, not subject to the control of any other person whatever.in the event of her marriage, however, I give to my wife Julia my negro man Fred and my negro woman Grace for her use during her life, then to be sold and divided as my other property. Item 5. I further desire and direct that in the event of the death or marriage of my wife during the minority of any of my children that the sum of one hundred dollars be set apart and allowed such child or children annually during his or her minority for their raising and education. Item 6. I hereby appoint my wife Julia Terry and Thomas S. Gilham, my executors to carry out and execute the provisions of this my last will and testament. John Terry. Signed sealed and declared and published by John Terry as his last will and testament in the presence of us the suscribers who suscribed our names hereto in the presence of said testator and each other. "State of Georgia. Before me, Wiley H. Sims, Ordinary of said Troup County came in person Julia Terry, executrix of the last will and testament of John Terry, deceased, late of said county and all the witnesses to said will. Littleton Pitts and John Henderson who being duly sworn deposeth and sayeth that they saw the said John Terry sign seal, publish and declare the said instrument as his last will and testament, voluntary and freely without compulsion and that they signed said will as witnesses in the presence of said John Terry and each other said that they also saw Henry H. Gary sign the said will as a witness to the same in the presence of the said testator and that testator at the time of executing the same was in sound and disposing memory. Littleton Pitts. "John T. Terry and his wife are buried in the Birdsong - Terry - Freeman Cemetery, Troup County, Georgia, near the Antioch community." (Information concerning John T. Terry and his family were obtained from the La Grange, Georgia Archives by Mr. and Mrs. G. T. Terry, Lanett, Alabama. Copies of these records were given to Mrs. George L. (Bob) Terry and copies were later given to Sidney A. Terry, who compiled this portion of these records.)
