Man Held Under Bond for Death of Wayne Jacobs.
Fatal Crash took place near Energy Sunday Night; Funeral Services HeldWednesday Afternoon
Funeral services for Wayne Jacobs, who died in the Herrin hospitalfrom injuries sustained in an automobile accident Sunday night, wereheld at 2 o'clock Wednesday afternoon at the Frist Christian church,Elder G.W. Osteen and Elder W.H. McWherter had charge of the services.
Kenneth Chapman and Howard Trout who were in the automobile withJacobs were seriously injured but are now considered out of danger.Jacobs sustained a broken back and an operation failed to save hislife. He died early Monday morning.
An inquest was held at the city hall Tuesday morning and a verdict wasretured which held Francis Bailey of Herrin, responsibel for thewreck. He is now being held under $5000 bond to await the actions ofthe grand jury.
The verdict returened byt he cornorer's jury reads as follows: "Wefind that Wayne Jacobs came to his death on Oct 4 caused by a cardriven by Francis Bailey, in an intoxicated condition and drivingrecklessly. We the jury recommend that he be held under bond to awaitthe action of the grand jury."
Three automobiles figured in the wreck and according to the evidenceat the inquest, Bailey hit both the other cars. He passed a Fordtouring car on a top of a hill and failed to stay on his side of theroad, hitting the car in which Jacobs was riding.
The three Johnston City boys were rused to the Herrin Hospital by RayWiggins, one of the chief witnesses at the inquest. The boys were allunconcious and their automobile was completely wrecked. G.T. Cox ofHerrin, and State Patrolman Harold Crain and Wallace Duncan testifiedthat Bailey had been drinking and that he was drunk enough to staggerwhen he walked. Witnesses testified that Charles Mazley, who wasriding in the car
with Bailey, was drunk and had to be helped to another automobile tobe taken to Herrin jail. Abe Wingate and Ray Richerson, deputysheriffs of Herrin testified that they talked with Bailey soon afterthe accident that they were unable to tell that he had been drinking.
Lan Haney, assistant state's attorney and Attorney Ray D. Henson andCorner W.E. Clayton of this city conducted the inquest. The jury wascomposed of George Nixon, J.W. Bell, H.E. Pike, R.J. Stirits, G.W.Young and H.W. Foster.
Wayne Jacobs is the son of Mr and Mrs Walter Jacobs of 608 E. 7thstreet.
Howard Trout, the son of Mrs. and Mrs. John Trout and Kenneth Chapman,son
of Mr. and Mrs. Alva Chapman are students in the Johnston CityTownship
High School.
