Book Q Page 74 of Deeds, St. Charles, Co., MO, contains the will of Timothy McCoy:
" I Timothy McCoy of St. Charles County State of Missouri, being weak in body, but of sound and disposing mind, do make and ordain this my last Will and Testament. 1st: I will and bequeath to my son James and daughter Sarah Margaret children by my first wife one hundred acres of land adjoining William Van Burkleo, being the same that was deeded tome by the said Wm. Van Burkleo, to be equally divided between them, also to my said son my three years old sorrel colt, to my said daughter,one cow. 2nd: I will and bequeath to my mother-in-law Mary Rowner a red cow and a red three year old heifer, also her support during life out of my estate. 3rd: I will and bequeath the ballance [sic] of my property after my debts are paid to my wife during her life, she paying my debts. 4th: I will and bequeath, after the death of wife, the above property lands and effects, rights and credits, to be equally divided between my three children by my present wife to with, Charles, Felix and Elizabeth. 5th: After my decease my personal estate shall be appraised and in the event my wife shall marry, I will that she shall give to the County Court, subject to its approval, bond and security for the refunding the amount of such appraisement and on failing to do so the property thus appraised shal [sic] immediately vest in said children Charles Felix and Elizabeth. I appoint my wife Susanna Jane McCoy, my executrix, to execute this my last will and testament. Witness my hand and seal this sixth day of February, one thousand eight hundred and forty three. Interlined in the fifth line from the top of this page the now children, before signing.

County of St. Charles } Be it remembered that on the first day of March 1843 in open Court before the County Court of St. Charles County was produced the foregoing last will of Timothy McCoy and Felix Scott,George Z. Burns and Daniel Iler the subscribing witnesses thereto appeared in open court and being duly sworn upon their oath say that the said Timothy McCoy signed the same as his last will in their presence by making his mark thereto and that they the said witnesses in the presence and at the request of the said McCoy signed the same as witnesses and in the presence of each other the said Iler signing by making his mark and at the time of signing the same said Timothy McCoy was of sound and disposing mind. In witness whereof I, Ludwell E. Powell Clerk of said Court hereunto set my hand and affix the seal of Said Court the day & year aforesaid.
