The following is a write up on the early Foote family of Stafford Co.,Virginia from "Virginia Heraldica":
"Arms: Vert a chevron between three martlets argent.
"Crest: A lion's head erased.
"Motto: Pendentim.
"The Footes were an old family long settled in the county ofCornwall [England]. In the register of St. Paul's Parish, Staffordcounty, Va., are the following entries concerning the family: "RichardFoote, gent., was born at Cardenahm, in the county of Cornwall, the 10thof August, Anno 1632. Was married the 19th day of Dec., 1657 to hisbeloved wife Hester, the daughter of Nicholas Hayward of London, grocer,who was born in Allhallows Parish, the 24th day of March, 1639-40."Richard Foote came to Virginia to manage the extensive business ofNicholas Hayward; he returned to England and there married the daughter,Hester. They had issue, the following children: (1) Samuel, born 25Jan., 1659, died 1697; (2) Susannah, born 13 Aug., 1658; (3) Mary, born 1Oct., 1662, died 1664; (4) John, born 27 March, 1665, died 1692 atJamaica; (5) Richard (first of the family to settle permenantly in Va.),born 31 Jan., 1666; (6) Elizabeth, born 27 Oct., 1668; (7) Mary, born 10Jan., 1670; (8) Hester, born 8 Dec., 1672; (9) George, born 22 Oct.,1673; (10) Sarah, born 22 Oct., 1675, died an infant; (11) Sarah, born 27June, 1676; (12) Francis, born 8 Jan., 1678, died 1697; (13) Henry, born5 July, 1680; (14) Mathias, born 13 Dec., 1683, died an infant. RicahrdFoote, the younger, born 1666, settled in Stafford county, Va., where hedied 21 March, 1729. Owing to the destruction of the records his wife'sname is unknown, but he has issue: (1) Richard, born 1704, Justice ofStafford in 1745, and who left issue; (2) George; (3) John, d.s.p.; (4)Hester, married John Grant of Prince William, gent; (5) Elizabeth."

The following peices of information were obtained from Pat M. StevensIV.
"The Footes were an old family in Cornwall, possessing large estatesthere prior to 1420. Richard came to Virginia as an agent for NicholasHayward in about 1650. Soon thereafter he married Hester, and went on tobecome a succesful merchant in London.
Richard's birthpalce is established by an old register of birthspassed down from generation to generation by the Foote familydescendants. It begins: Richard Foote, son of John Foote, Gent. was bornat the County of Cornwall, the 10th day of August, Anno 1632.
Richard married Hester Hayward on Oct 19, 1657 in St. Leonard'sAnglican Church of Shoreditch, London. On Aug 13, 1658 Susannah wasborn, but lived only a few days. On Jan 25, 1660 Samuel was born. Marywas born Oct 1, 1662 but died in May 1664. In 1665, the Great Plaguesturck London, and it's probable that Richard took his family to Cornwallto escape it. Richard II was born Jan 31, 1666 probably in Cornwall dueto the Great Plague which killed 100,000 in London during the last eightmonths of Hester's pregnancy. At 1:00am the morning of Sunday, Sept 2,1666, the Great Fire of London erupted and burned until Wed, but the homeof the Foote and Haryward families and other of Shoreditch were spared.Elizabeth was born Oct 27, 1668. In Jan 1670, Mary was born but livedonly nine months. Hester was born Dec 8 1672, but died and was buried 10days later. George was born on Oct 22, 1673 and Sarah was born Jun 27,1676. Frances was born Jan 8, 1678, followed by Henry on July 5, 1680,and Mathias on Dec 13, 1683, but he soon died."

The Fitzhugh letters and other documents were edited by RichardBeale Deuts, published at Chapel Hill, NC, The University of NC Press1963. In one letter from William Fitzhugh to Nicholas Hayward, June 1,1688, Fitzhugh tells Hayward that his cousin, Mr. Foote, since hisarrival has not given him the honor of his good company, that is, sinceFoote had arrived in Virginia. Fitzhugh was a lawyer and processor forvarious merchants and business people in London. In the note #2, it isgiven as follows: Richard Foote, the younger, 1666-1724, was the son ofNicholas Hayward's sister Hester and Richard Foote, one of the partnersin the Brent Town Enterprises. The elder Foote was just 20 in 1652 whenhe came to Virginia as an agent for Nicholas Hayward, Sr. The elder Footereturned to London within 5 years and married his employer's daughter,Hester Hayward.
Richard Foote became a successful merchant though Fitzhugh's laterreferences to the younger Foote are hardly complimentary. The youngerRichard Foote, did settle in Stafford Co. at Brent Town and was by 1700 aJ.P. This is taken from Harrison Landmarks, Book 1, page 193 and manyother places. In the introduction to the letters of William Fitzhugh wefind that Brent Town Tract was secured by George Brent, Nicholas Hayward,Robert Bristow, and Richard Foote I through the grant of Feb. 10, 1687.In the transaction, Fitzhugh acted as attorney for Thomas Lord Culpepper.The Fitzhugh note said that although this Brent Town Project may haveoriginally been designed for the smaller tract owned by Hayward, byJanuary 1686-87, the proprietor made a grant of 30,000 acres in upperStafford Co., now Prince William, to Nicholas Hayward and his partnersRobert Bristow, Richard Foote I, and George Brent and on July 13, 1687,it was recorded in Stafford Court. The revocation of the Edict of Nantesin 1686 had caused an influx into England of Huguenots. Hayward and hisassociates hoped to encourage them to settle on lands in Stafford. In theWilliam & Mary Quarterly, page 260, Quarterly #20-186, there is thisnotation: Richard Foote of London, merchant, on July 14, 1656, landed atDeal in Kent the 11th present out of the Golden Falcon of London. RichardFoote, b. Aug. 10, 1632 in Cardenham Co., Cornwall, England, marriedHester Hayward Oct. 19, 1657, daughter of Nicholas Hayward, merchant, ofLondon, who dealt with Virginia.

Will of Richard Foote, merchant of London:
His personal estate to be divided into three parts according to thecustom of the City of London: one third to his wife Hester Foote (in fullof his personal estate except as elsewhere bequeathed to her); one thirdto be divided among his five children Richard, George, Sarah, Francis andHenry, the rest of his children (Samuel Foote and testator's daughterElizabeth Holmes) being already provided for; from the other third, 100Pounds [money] to Samuel Foote. (It is not clear whether legacies belowalso come from this last third.)
To Elizabeth Holmes 200 Pounds.
To Richard Foote 600 Pounds, and 3000 acres of land, part oftestator's
lands in Virginia.
To George Foote 100 Pounds and 1000 acres of his land in Virginia.
To Francis Foote and Henry Foote 800 Pounds apiece at 21, and toeach 1000 acres of his land in Virginia. From legacies to Francis andHenry the executors may lay out up to 200 Pounds apiece to Apprenticethem; interest on their legacies goes to their mother for their upkeep.
To his grandson Topham Foote 200 Pounds, which his father Samuel Footeshall put in trade for him till his majority; also 1500 acres of his landin Virginia.
The rest of his estate to his wife Hester Foote, who is named jointexecutor with his son Samuel Foote.

The will of Richard Foote of St. Dunstan of East London, who had lands inVirginia, was probated in April 1697.
