HICKS, HORACE LYMAN, Albany; son of EDWARD HICKS, b. 1813 (m. Helen Mar Soule); son of Samuel, b. 1752, d. 1820 (m. Mary Sheppard), engaged in battle of Plattsburg, 1812; son of John, b. 1725, d. 1775 (m. Elizabeth Nutting), killed in the battle of Lexington; son of John; son of Zachariah, b. 1657 (m. Ruth, dau. of John Greene); son of Zachariah, b. in England, 1628, d. in America, 1702 (m. 1652 Elizabeth Sill, d. 1730), settled in Cambridge, Mass.; son of THOMAS HICKS of London, England (m. Margaret, dau. of Zechariah West, a linen draper of London), came from England about 1630, his brother Robert having preceded him and settled in Scituate, Mass. In his will, dated Jan. 10, 1653, he mentions his three sons, Zechariah, Daniel and Samuel; died at Scituate about 1653.
 The English descent of THOMAS HICKS is as follows:
He was the son of James (m. Phebe, perhaps a daughter of Rev. Ephraim Allyne of Hertfordshire); son of Baptist, b. about 1526 (m. Nancy, dau. of James Everhard); son of Thomas Hicks of Tortworth, Gloucestershire, which estate he inherited from his father, John Hicks, and on which he resided until his death (m. Joan Darney). This Thomas was the eldest son of John Hicks who was lineally descended from Sir Ellis Hicks who was knighted by Edward the Black Prince at the battle of Poictiers, Sept. 19, 1356. In the English Baronctage (see Foster's Edition, 1881, p. 311I the lineage of Sir Michael Hicks-Beach, Bart., of Beverstone, Gloucestershire, is traced to Robert Hicks, the son of John Hicks of Tortworth. Harriet Woodbury Hodge, in ‘’Hicks (Hix) Families of Rehoboth & Swansea, Mass., 1640-1850’’ (1976), LDS #1036844, pp 5-7; 9-10, reviewed land deeds, probate records, vital records and found no evidence of his English ancestry, parents or brother-relationship to Robert Hicks of Plymouth. Therefore, we are detaching him from James Hicks and Phebe Allen.
Neither has any proof been found that Thomas came on the ship "Anne" in 1623 with Robert Hicks' wife and family.
Biography

Born about 1590 in England.
Some say he was born about 1576 in Southwark, Surrey, England[1]
Thomas was in Scituate by 1640 where he took the oath of fidelity in 1644.
He married about 1629 possibly in Southwark, Surrey, England (others say after emigration in 1625 in Massachusetts— Source citations needed for both) Margaret (______); she has been called "West" (daughter of Zachariah) [2] or "Atwood" but no proof of either surname appears in records.
He died between 10 January and 9 June 1653 in Scituate, Plymouth, Massachusetts.
On 9 Jun 1653, "Widow Hicks, wife of the late deceased Thomas Hicks of Scituate, by reason of age and weakness cannot appear in Court to make oath to the inventory of is estate and for like reason, also, the witnesses to the will of Thomas Hicks cannot appear in court to make oath there unto..."[citation needed]

Written 10 Jan 1652/3, reported at Plymouth court 9 Jun 1653;[3] oath of Margratt Hicks to the inventory taken 3 Oct 1653.
..."I will and bequeath unto my sonne Zachariah five shillings to bee paid by my wife Margrett hicks whome I make my whole exequitrix within a twelvemonth after my Decease; I will and bequeath unto my wife Margrett and to my sonns Daniell and Samuell all my lands with Dwelling house and out houses and gardens and all therto belonging and my house lott which is by estimation thirteen acres; as alsoe my hundred acres of upland with the Marsh therto belonging which I bought of John Whetcome the elder of Scituate planter... I give it my two sonnes Daniell and Samuell upon this proviso that they bee Obedient unto Theire mother and carrys themselves as they ought soe as they may live comfortably together but if the one or both live otherwise then they ought and undewtyfully ad unquietly with theire Mother that they cannot comfortably live together the hee that soe carryeth himselfe shall Disinherit himselfe of his pts of this land During my wives life; and after her Death all this land above written shalbee equally Devided between my sonnes Daniell and Samuell; My will is if my wife should change her condition and Marry then shee shall have but one third of my land above written; It I give unto my wife all my moveables and my two young Cattle..."[4]Sources
