Dutton received a land grant for 200 acres on the Elk River in Franklin Co., TN on 8-15-1807. Joseph Martin was the original grantee. The land grant was grant no. 855, certificate no. 5, and recorded on 10-20-1807.Dutton and Rachael were already living on this land at the time of the grant therefore they must have left Anderson Co., TN after the 1805 Tax List was preared for that county.
Several Martin family member also moved to this area settling on Boiling Fork of the Elk River near Winchester and Beane Creek near Salem.
Dutton's brother, John, settled on Indian land about 20 miles south of Dutton and Rachael. This area became known as Sweetens Cove.

Dutton was invited to attend the meeting which formed the Elk River Baptist Association. The association was made up of the 4 Baptist churches in Franklin Co. including the Hopewell Baptist Church which was the one attended by Dutton and Rachael.Isaac Reed also attended. He became a United Baptist preacher-teacher, moved to TX in 1830's, and died in Panola Co., TX in 1847. His grave is marked with a Texas State Historical Marker.

In Aug., 1826 Dutton acquired 320 acres recently vacated by the Chickasaw Indians. The area was claimed by both AL and MS. Dutton thought he was in MS but eventually his land was divided by the states border so that 220 acres were in TN and 100 acres were in MS. His residence was on the TN land since he is found in the 1830 and 1840 TN Census.Census

On 5-4-1842 Dutton sold his property in Hardeman Co., TN and across the MS state line for $1800. His whereabouts is unknown from this time until 1845. He may have lived with his son, Dutton M., in Tippah Co., MS near Graham, MS in the area was known as "Sweeten Hill". This area is now in Union Co., MS.Event-Misc

He recived a land grant in Tippah Co., MS for 159.1 acres. The land description was SE corner of Section 16, Township 5, Range 4, which is near his son, Dutton M., and close to Graham, MS. His residence was given as Pontotoc Co., MS on the grant. Pontotoc Co. at the time was adjacent to Tippah Co. and near Graham, MS.The museum in Ripley, MS diplays a map showing the location of this land grant.

On 2-17-1846 Dutton purchased 160 acres which was the NE corner of the same section as his land grant. He paid $300 for this land. His name is given as Dutton, Senr. on the deed.On 4-1-1846 he sold this property to his sons, Joseph and Dutton M., for $300. Joseph bought 100 acres and Dutton M. purchased the remaining 60 acres.

After Dutton's death several court cases developed involving members of the Sweeton family.Case 898: State vs. Marion Sweeton (Dutton's son)- assault and battery on Jane Arnold with intent to ravish. The outcome is unknown since the Circuit Court Record Book has been lost or destroyed.
Case 3040: State vs. Jesse Sweeton (Dutton's nephew)- assault and battery on Wesley Tate. Jesse pled guilty and paid $5 fine.
Case 3081, Sep., 1849: Samuel M. Sweeton (Dutton's son) vs. Eli M. Sweeton (Dutton's nephew and administrator of his estate)- Samuel accuses Eli and Marion Sweeton ( Dutton's son) of wrongfully taking a slave named Burrell. The outcome is unknown.
Case 3136, Mar., 1850: Rhoda Chapman (Dutton's niece) vs. Eli and Marion Sweeton- Chapman claimed a slave, Sukey, and her young daughter, Sarah, were taken illegally by the Sweetons. The outcome is unknown.
Case 3190, Mar., 1850: State vs. Marion Sweeton- Marion indicted for assault and battery on Samuel Sweeton on 9-2-1850. Marion paid $5 fine.
Case 3191, Mar., 1850: State vs. Marion Sweeton- Marion indicted for assault and battery on Joseph B. Sweeton (Dutton's son) on 9-2-1850 . Marion paid $5 fine.
Case 3192, Mar., 1850: State vs. Marion Sweeton- Marion charged for exhibiting a deadly weapon in a public place. Marion pled guilty to pulling a gun on and assaulting his brothers, Joseph and Samuel. He paid $1 fine and spent 1 hour in jail.

Dutton sold his Elk River property in Jan., 1818 and began his move to Perry Co., AL. Dutton's brothers, Eli and Jesse, probably moved also. The area they settled on was in the Catawba Valley of what is now Perry Co., AL and had just been acquired by the U.S. government from the Creek Indians. The land had not been surveyed but when thousnads of settlers moved into the area, Congress allowed them to stay on the lands and gave them several years to record their claims resulting in no deed or tax records for several years.Event-Misc
Records of the Oct., 1819 meeting of the Catawba Association of Baptist Churches held at the Ebenezer Church show that Dutton was admitted to the ministry as a licentiate which allowed him to preach but not perform any church sacrements.Endnotes
