John Walters
( - 10 Oct 1836)
1790 Reconstructed Census (tax list) Franklin Co GA: Robert Walters, John Walters, Moses Walters and Peter Walters. Charles Cawthon, Claborn Cawthon, and David Cawthorn. Mathias Magbe (McBee) and James McBee.
Franklin Co GA Tax list of 1798 includes a John Walters. Listed with 1 dwelling, 5 out houses, 2 acres, value $108. District 7, 3rd Division.
John, along with his brother Robert, was designated one of the Executors of his father's will written 2 Nov 1793. They reported the Inventory of the estate in Court, 8 Nov 1794.
The Walters book states that John Walters died leaving his will in Franklin Co GA on 9 Jul 1819 - this does not agree with other information that he went to Dallas Co AL. The Walters book also refers to him as John "E." Walters. There was also a John C. Walters living in Franklin Co. I suspect many of these records to have been confused. There was a John Walters living in Dallas Co AL in 1830 but he was aged 80-90 at the time, or born by 1750 which seems to be too old to be this John Walters, but then old folks ages' were often exaggerated, and the alternate birth year seen as 1775 seems much too late.
He is possibly the John Walters that married Mary Madding on 28 Mar 1782 in Pittsylvania Co VA. His father did have neighbors named Madding. Obviously his wife was a Mary - see deed to follow. Another marriage given which is more likely is that his wife was Mary Cawthon, a daughter of Charles Cawthon & ??? Womack - which could also have been a 2nd marriage. I have also seen that he married Mary Cleveland, but that was his nephew John Jackson Walters, son of Robert Walters Jr.

John said to be on the Wilkinson Co GA 1820 census but I didn't find them there. I think the references to a John in Wilkinson Co GA is a different family. The 1830 Franklin Co GA census shows a Mary as head of a Walters household. 2f 10-15, 1f 20-3, 1f 70-80, but this was more likely the widow of Robert Walters Jr. The Walters book makes the assumption that the John Walters in this place was born 1750-1760.
Children suggested are a John E. Jr, Richard A. & James.
John E. married Rhoda Cawthon on 7 Jul 1799 in Pittsylvania Co????? [this is highly questionable given that by 1799 the Cawthons & Walters both lived in Franklin Co GA. Said to be on the 1820-1840 census in Wilkinson Co GA.
Richard A. Walters married [1] Mary Lassiter in 1814 who died 1856. Married (2) Mary A. Harmon. May be in the 1850 & 1860 GA censuses.
James was born about 1795 in Georgia, married Sarah Delk. Found in Wilkinson Co GA 1820 - 1860.
Early Census Substitutes for Alabama include a tax list of 1816 - John Walters was in Madison County, Alabama Territory.
John was most likely in Dallas Co, Alabama, at the time the county was formed in 1818 [Alabama was still a territoy; statehood came 14 Dec 1819]. OLD CAHABA LAND RECORDS book shows that John Walters paid a receipt for Section 8, Township 18, Range 10 on March 1819. Section 8 seems to have been on the Dallas/Perry Co line and some records show him to be in Perry Co. Patents issued before 1820 are not available on the Federal Land Bureau site.
Later patents issued to Walters, that might be of the next generation were:
John E. Walters, S8, T18, R10 [Same as John above] Perry Co - 1831
Samuel, S9, T18, R10 in Dallas & Perry Counties - 1834
George W., S22, T19, R9, Perry Co - 1837
James B., S2, T20, R8, Perry Co - 1840
There was an Alabama State Census in 1820.
Listed in Dallas County was John Walters: 1 White male over 21, 0 white males under 21, 1 white female over 21, 1 white female under 21, 3 total white inhabitants 5 slaves, Total of 8 inhabitants. [this census supplied no clues to the ages of the inhabitants]
Robert B. Walters has information that John Walters and his daughter Millie & her husband Charles Warren, were members of the Ocmulgee Baptist Church in Perry Co AL on 26 Dec 1824. He gives children as Betsey, Hannah, John, Joseph, Millie who married Charles Warren, and Samuel.
