It is said that all three of Nancy and Ira's sons served in the Confederacy. John was a Lieutenant, but not for long.

John remained in Davidson Co - he married Mary Magdalene Roberts about 1859 and had ten children, 3 dying as infants.

Mustered out 19 Dec 1862.

I believe John was not particularly enthusiastic about the War. On 29 May 1866, he applied for his Presidential pardon. He stated he was a native born citizen of North Carolina, age 32 and a farmer, living in Davidson County, NC. He was conscripted and forced into the Rebel service of the "so called confederate Army" about 1863 [he appears to have written either 1 or 2 first, and then written the 3 on top, so apparently confused about the year] in July and was promoted to the rank of 3rd Lieutenant and served only four months before resigning. He evaded further active service by serving at Post Master at Hottsburg. He was never worth more than $5000 from the time of the commencement of the rebellion and he has taken the Amnesty Oath, a copy of which is attached. At the time the vote was taken to secede, he voted in the negative and suffered abuse from those with whom he differed. He feels he is entitled to clemency and pledges himself to observe all laws, etc and demean himself to meet the approbation of all loyal and law abiding men. signed: J. B. Fitzgerald.
The Oath was attached, signed 9 Sep 1865.
A letter of recommendation for clemency was from C. F. Lowe, dated 30 May 1866, at Lexington, NC.
