The last will and Testament of John Mulberger of Harris Township, Centre County. I John Mulberger considering the uncertainty of this mortal life and being of sound mind and memory and blessed by Almity God for the same do make and publish this my last will and testament in manner and form following, that is to say I order that all my Just debts funeral Expenses and charges of Proving this my will be in the first place fully paid and satisfied and after payment thereof and every part thereof my will is that Margaret Mulberger Intermarried with Samuel I Bush is to have my house and lot amounting to six acres of land and in will is that Chartharine Mulburger wife of Daniel Mulberger to have my cow and hog and my will is that my personal property is to Equally divided between Catharine Mulberger and Margaret Mulberger Intermarried with Samuel I Bush share and share alike and further my will is that all my money at my decease is to Equally divided between Catherine Mulberger and Margaret Mulberger intermarried with Samuel I Bush share and share a like and I do humby constitute and appoint George Johnston --- be executor of this my last will and testament hereby severing all former wills by me made in witness where of I have here unto se my hand and Seal this 20th day of April A. D 1859. John (his mark) Mulberger. Witness: Peter Schrick and James Williams. Will proved 6 May 1869.To the Honorable Judges of the orphans Court of Centre County. The petition of Saml I Bush and Margaret Bush his wife, late Margaret Mulberger and Catharine Mulburger widow os Danl Mulburger deceased, heirs and legatees under the last will and testament of John Mulberger late of Potter Twp Centre County, deceased. Respectfully represents that George Johnstonlaugh Executor under the last will and testament of the said Jon Mulberger deceased settled his account as Executor of said decease, which by a final decree of this court was confirmed on the 26th day of August A.D. 1868. The petitioners further represents that there are errors in said account which is specifically sets forth as follows: 1st The executors charges as compensation for his services are immisable and exorbitant. The whole estate to be administrated upon amounted to last six hundred and sixty one. 48 Dollars of which Six hundred and thirty nine dollars and forty with cents was lawfull money in silver coin and the balance twenty two (22) Dollars in clothing house land and ------. -- which was taken at the appointment =by the litagee under the will leaving nothing but $639.48 in silver coins to be dispursed amount the two lefeeters after declaring funeral and other necessary expenses. Under these circumstances your petitioners respectfully represent that the change of Sixty (60) Dollars in acculumation to Connel fees. It is unreasonable and eyer bit-- and ought not to be believed. 2nd The said Executor after receiving the above named sum of 639.48 in silver coin disposed of the same at a ------ of twenty seven percent with which premium be neglected to charge himself in his account settled filed and confirmed as aforesaid. Thus appropriate Said permission to his own violation of the rights of your petitioners. Your petitioners further represent the balance as states to be due by the said account as confirmed has never been paid over or discharged and in ------- represents the balance as states to be due by the said amount as confirmed has never been paid over as discharged in any way by said Executor, and therefore prays the court to receive said account and grant a no hearing before alleged to be in error.
