Last Will of Isaac UnderwoodIn the name of the Supreme Being, Amen.
Be it known that I Isaac Underwood of Hamilton County, State of Indiana, being weak and feeble in health, but sound in mind, wishing to make a deposition of my worldly effects, as it seems agreeable to my mind and feelings at the present time, do make and constitute this my last will and Testament.
Item 1: After my decease I desire that my body may be buried in a manner corresponding with estate and circumstances in life, without any ostentations or parade in the case, and that my funeral expenses and all my just debts be paid out of the proceeds of my personal estate.
Item 2: "My real estate consisting of the House Farm on which I now reside, being the south-east quarter of Section No. Thirty-two (32), in Township Twenty (20), North, Range three (3), East, I will and bequeath to my heirs at law, giving to my wife Catharine L. Underwood all her legal title to dower in the same, with all the rents and profits arising from the same, for the support and maintenance of said heirs, so long as it shall be to their interest to remain in their possessions. Should it be considered to the more comfort and satisfaction of he family to make an exchange of he property for the purpose of locating in some more desirable place for the convenience of schools or meeting privileges, then and in that case the exchange may be made, provided that no sacrifice in value shall attach, and the same is sanctioned by the proper authority having jurisdiction of the same.
Item 3: My personal property consisting of stock of horses, cattle farming implements, household and kitchen furniture may be sold at public or private sale as may be considered to the best interest of the estate, reserving from sale all property that is necessary for the comfort and proper management of he farm and support and maintenance of the family.
Item 4: My family carriage I give to my wife Catharine L. Underwood with a horse of her own selection, and harness for the same, and also any and all property or moneys, devised from the estate of James A [page 182] Dakin, late of Warren County State of Ohio, is hereby bequeathed to the same, to be controlled by her, with the advice and consent of any executors hereafter named
Item 5: I hereby nominate and appoint my beloved wife Catharine L. Underwood, John Underwood and Lewis Underwood my executors with full power to execute all the provisions of the foregoing will, and I hereby request that they shall freely consult each other in all matters relating to the settlement of my estate.
In witness whereof I have hereto set my hand and seal this 31st day of August 1876.
