The will of Arthur A. Pond, brother of Judge Pond, who died recently, leaving considerable property, was filed yesterday in the probate court. Charles M. Pond, Jas. C. Slofter, and a son, Chauncey C. Pond, are appointed executors. The will asks that Margaret E. Case, Hattie L. Case and Chauncy C. Pond allow the money due them from the estate to remain in the hands of the executors. It bequeathes to the wife, the homestead on Second avenue south, between Twelfth and Thirteenth streets, for the term of five years, when the executors are empowered to sell it. She is also given a team of horses, carriage and harness complete. She is also to have $10,000 placed in a trust and to have use of the interest thereon. Interest is to cease at her marriage or death. Edgar R. Pond gets $3,000 and Etta C. Sargent $3,000 to which is added $2,500 in case she was unmarried at the decease of the maker of this will. P. L. Pond, an uncle, gets $2,000, or his wife if she survive him. The balance of the estate is to be held and managed by the executors for 10 years after the probate of the will for the benefit of the wife, to the extent of $2,500 per year, excepting that if the income from one-third of the estate exceeds that amount she shall have the excess. If the wife is living at the end of 10 years a division is to be made and she is to get one-third, the balance going to the children, share and share alike. In case of the death of the wife, Mrs. Emma Crosby, her sister, is to get $5,000. To Ward H. Hasey, her brother, is bequeathed $2,000; to Elijah Hasey, $2,000; to Charles Hasey, $2,000; to Ambrocene S. Follett, $2,000; and Albert A. Spencer, the wife's son, $2,000. In closing the document apologizes for not giving Mrs. Margaret A. Case or Hattie L. Case a share, by a statement that the deceased well knew they were generously provided for through life by others. The petition to prove the will, filed by Judge Charles W. Pond, shows that the personal property is valued at $25,000, and the real property $150,000, $110,000 of which is in improved city property. The heirs specified are Prudence G. Pond, widow, Emma E. Pond, Harry A. Pond and Chauncey C. Pond, children, all of Minneapolis; Edgar B. Pond, a brother, of Clinton, Mass.; Ella C. Sargeant, a sister, of this city; P. L. Pond, an uncle, of East Holden, Me.; Mrs. Emma Crosby, sister-in-law, of this city; Ward B. Hasey, brother-in-law; Mrs. A. S. Fallett, sister-in-law, and Albert A. Spencer, step-son, all of Haverhill, Mass.; Elijah Hasey and Charles E. Hasey, brothers-in-law, of this city.Newspaper Article
