Wm A. Duggins of Preble County Ohio, of full age, of sound mind and memory and not laboring under any restraint do make and publish this my last will and testament in manner and form following to wit:Item 1st It is my will that at my decease all my just debts and funeral expenses be paid
Item 2nd I do hereby bequeth, will and devise unto my son Benj A Duggns Eighty five acres of land more or less being the North half of the NorthEast quarter of Ection 17 seventeen, Tp 7 Range 2 East in Preble County Ohio and to his heirs and assigns forever
Item 3rd I dohereby will devise and bequeth unto my son Henry J Duggins eighty five acres of land more or less being of the South half of the NorthEast qr of Sec 17 seventte Tp 7 R 2 East in Preble County and to his heirs and assigns forever.
Item 4th I do hereby will, devise and bequeth unto my son Wm N Duggins eighty acres of land being the West half of the Northwest quarter of section 10 Ten Tp 8 R2 East in Preble County O and to his heirs and assigns forever
Item 5th I do hereby will devise and bequeth unto my daughter Sarah D Kincaid, wife of John Kincaid, eight acres of land being the East half of the North West qrt of Sec ten (10) Tp 8 R 2 East in Preble County Ohio and her heirs The road on the S line of said NW Qr of Sec 10 to be kept open.
6 I do further will devise and bequeth unto my sons, Benj A Duggins, Henry J Duggins and Wm N Duggins the sum of five hundred dollars each to be paid to them out of my personal estate or if my said personal estate be not sufficient to pay this legacy it is my will then that the one hundred acre tract of land, described as follows being the North part of the SE qr of Sec 10 and a part of the SW qr of said Sec 10 Tp 8 R 2 E in Preble OCunty Ohio be sold at private or public sale as my children may agree which I hereby authorize them to do and to make execute acknowlege and deliver good and sufficient warranty deeds to the purchaser or purchasers there of and so much of the proceeds there of as shall be necessary shall be used in the payment of the legacies above described in this item, and the residue there of I doe hereby will and devise unto each of my said four children share and share alike.
Iteh 7 It is my will that at my decease, all the personal proberty of every kind and description which I may die siezed shall be equally divided between my said four children share and share alike, or if my said children shall not agree as to the actual division of the specific property, then it is my will that the same shall be sold in such manner as my said children or a majority of them shall agree, and the proceeds thereof be equally divided between them. The foregoing disposition of my estate is made so that my said children shall share as nearly equal in my estate s possible.
I having heretofore made advances to some of them to a greater or less extent thanothers and the foregoing is intended to make them all equal.
Item 8 It is my will that in case my wife survives me, that her living and support be charged upon my entire estate and my said children and their heirs are herby enjoined and required to give my said wife Sally, a good and ample support and maintenance so long as she lives.
On witness whereof I have hereunto subscribed my name and affixed my seal, this 21st day of August A.D. 1871.
