Event
This Indenture made on the third day of December in theYear of our Lord One Thousand Seven hundred fifty & two Between John Eaden
of S.t Marys County Gentleman of the first part James Heard ^of the same County Gentleman of the second part and James Neale^ of same County
Gentleman & Elizabeth his Wife of third part Whereas the said John Eaden in April
Term which was in the Year of our Lord Seventeen hundred fifty & one by Writ of
Entry Sur Disseisin en le Post did recover against the said James Heard All that
Divided Moiety of a Tract of Land called Cobrin lying in Saint Marys County afsd
near Clements Bay Containing One hundred and fifty Acres of Land be the same
more or less as in and by the said Recovery remaining of Record in the Provincial
Court of this Province of Maryland at Annapolis relation being thereunto had may
more fully and at large appear Now this Indenture Witnesseth That the True
Intent and meaning of the said John Eaden and of all the Parties to the said
Recovery before and at the time of suffering the said Recovery touching and
concerning the said Land and Premisses whereof the said Recovery was suffered
always was and yet is that the said Recovery and other Acts and Assurances
of and concerning the s.d Land & Premisses with the Appurtenances at any time
formerly suffered Executed or had wherein or whereto the said John Eaden is in
any ways a Party and all and every the Executions of the same should and shall be
and enure and be Construed Adjudged Deemed and taken to be and enure and
are hereby Covenanted Granted Agreed and Declared and the true intent and
meaning of the Partys to these Presents is that the said Land and Premisses
so as afsd Recovered shall be and enure and shall be Construed Esteemed
Adjudged and taken to be and enure and are hereby declared to have been
Intended to be and Enure to the Sole Use and Behoof of the said James Heard
his Heirs and Assigns for ever and to no other Use Intent or Purpose whatsoever
In Witness whereof the Partys to these Presents have hereunto Interchangeably
set their hands and Seals the day and Year first above Written

Justices of the Provincial Court John Eaden James Heard & James Neale &
Eliz.a his Wife Parties to the within Instrument of Writing and Acknowledged the
same to be their Act and Deed for the Uses Intents & Purposes therein mentioned
and at the same time the said Elizabeth was Privately Examined out of the hearing
of her said Husband and Acknowledged that she did the same freely and Voluntarily
without the Th^r^eats or Compulsion of her said Husband or for fear of his Displeasure

Dec.r the 9.th 1752
Received of M.r James Heard the Sum of six Shillings Sterling
for his Lordships Use (it being the Alienation Fine on the One hundred and fifty
Acres of Land within mentioned) By Virtue of a Commission from Benjamin
Tasker Esq.r his said Lordships Agent & Receiver General
